It shall be unlawful for anyone to use, ride, propel or otherwise operate a skateboard upon any of the public streets or avenues of the borough or upon the sidewalks adjacent to the same or on or within the boundaries of Airport Park.
As used in this chapter, the following terms shall have the meanings stated herein:
SKATEBOARD
A board of wood, plastic, fiberglass or similar material with roller-skate wheels or other type of wheels attached and used for gliding or moving on any hard surface.
A. 
First offense. The skateboard used in violation of this chapter shall be impounded by the Matamoras Police Department for a period not exceeding fifteen (15) days. If the person violating this chapter is under age eighteen (18) years, the Borough Police Department shall also notify the parents, guardian or other person having legal custody of said minor of the violation of this chapter and the impounding of the skateboard.
B. 
Second and/or subsequent offenses. The skateboard of any person violating the provisions of this chapter for the second and/or subsequent time shall be impounded by the Matamoras Police Department for a period from the time of the violation or apprehension of the suspected violator until the first of the following occurrences:
(1) 
Payment of the fine as herein provided.
(2) 
A magisterial determination in favor of the accused.
(3) 
Dropping or withdrawal of the charges.
(4) 
The 60th day following the date of impoundment.
C. 
In addition, the violator [or, in the event that the violator has not attained age eighteen (18) years on the date of the violation, the parent, guardian or other person having legal custody of said minor] shall, upon conviction of the violator, be sentenced to pay a fine of fifty dollars ($50.) and costs.
