In order to facilitate the movement of traffic
and to combat the hazards of excessive snow and/or ice on the streets
or portions of streets in the borough, the Chairman of the Streets
Committee or the Chief of Police, in his discretion, may declare an
emergency due to such hazards.
A.
After any such emergency shall have been declared, it shall be unlawful, during the period of such emergency, for any person to park a motor vehicle or to allow the same to remain parked on any street or portion thereof on which signs have been placed pursuant to § 118-41 below or to operate any motor vehicle on any such street or portion thereof unless such vehicle shall be equipped with adequate equipment to provide sufficient traction to keep such vehicle in motion so that other traffic on such highways will not be blocked or seriously impeded.
B.
No person shall cause any snow and/or ice to be placed
upon any borough street after the street has been plowed. The owner
of the property from which any such snow and/or ice shall originate
shall be responsible for such violation.
A.
In order to assist the operators of motor vehicles
in determining the streets affected by this Article, signs shall be
placed around the utility poles or on temporary stakes on the streets
or portions thereof affected by the emergency reading as follows:
SNOW
EMERGENCY
ROUTE
SNOW TIRES OR
CHAINS REQUIRED
NO PARKING
DURING EMERGENCY
VEHICLES
TOWED AWAY

B.
The Street Department or the Chief of Police shall
also, through radio, newspaper or other available media, disseminate
information as to the existence of such emergency.
A.
Any person who shall park a motor vehicle upon or along any of the streets or portions thereof posted as herein provided at any time during a period of emergency declared as provided in § 118-39 shall be guilty of a violation of this Article.
B.
Any person who shall operate a motor vehicle upon any street or portion thereof posted as herein provided and whose motor vehicle shall become stalled upon any of such streets during a period of emergency declared as provided in § 118-39 of this Article shall, if such stalling shall have been by reason of the failure to have such vehicle or tractor equipped with the equipment hereinabove prescribed, be guilty of a violation of this Article.
C.
Any owner of any property from which snow and/or ice
have been removed and placed upon a borough street after the same
has been plowed shall be guilty of a violation of this Article.
D.
Violations generally. Unless another penalty is expressly
provided by the Pennsylvania Vehicle Code or except as hereinafter
specified, every person convicted of a violation of a provision of
this Article or any supplement thereto shall be liable to a penalty
of not more than one hundred dollars ($100.) and costs of prosecution.
Each twenty-four-hour period that a violation shall continue shall
constitute a separate violation.
E.
Parking violations. Any person violating the provisions
of this chapter pertaining to parking shall, upon conviction, be guilty
of a summary offense and be sentenced to pay a fine of not less than
twenty dollars ($20.) nor more than fifty dollars ($50.) and costs
of prosecution.
