[Adopted 8-27-1996 by Ord. No. 1996-8]
As used in this article, the following terms shall have the meanings indicated:
BOROUGH
Millersville Borough.
BOROUGH COUNCIL
The Borough Council of Millersville Borough.
ENGINEER
The Engineer for Millersville Borough.
STREET
Any street, avenue, boulevard, road, highway, freeway, parkway, lane, alley, viaduct and any other ways used or intended to be used by vehicular traffic or pedestrians, whether public or private. Included is all the land between the street right-of-way lines, whether improved or unimproved. Streets may be comprised of pavement, shoulders, gutters, sidewalks, dividing strips or other areas within the street right-of-way lines.

A. 
General standards. All new streets shall be constructed in accordance with the specifications and procedures contained in this article, and the Borough may require that reconstruction of streets meet these specifications and procedures.
(1) 
All construction methods, equipment and materials shall conform to PennDOT Form 408, Specifications, latest edition.
(2) 
Upon request of the Borough, test samples of any product or material may be taken at the manufacturer's plant by a designated Borough official or, upon request, be delivered to the designated official at the Borough office at no cost to the Borough.
(3) 
Testing of such samples may be performed by an approved independent laboratory or at PennDOT's Bureau of Materials Testing and Research Laboratory.
(4) 
Testing for thickness or sampling of in-place materials may be required for individual courses and/or total pavement thickness. All costs of sampling shall be the contractor's responsibility. Any disputes shall be resolved by compliance with PennDOT's specifications.
(5) 
The PennDOT Form 408 referred to herein shall be the 1994 edition or latest edition thereof.
(6) 
Reference in the applicable PennDOT specifications and standards to “State Engineer” shall be interpreted as meaning Millersville Borough.
B. 
Grades for streets. PennDOT's guidelines for design of local streets (PennDOT Publication 190) shall apply, except that the minimum grade shall not be less than 1%, and the maximum grade shall not be greater than 8%.
C. 
Width of newly constructed streets in developments.
(1) 
Subject to the requirements of Chapter 325, Subdivision and Land Development, the paved roadway width shall not be less than 36 feet curbed with vertical curbs on both sides as detailed on Millersville Borough Design Drawing No. ST-C-1, which drawing is attached hereto, made a part thereof and marked as “Exhibit A.”[1] No slant curbs shall be permitted in Millersville Borough.[2]

(2) 
Extensions of existing streets within developments currently approved shall have a graded shoulder extending not less than eight feet in width on both sides of the paved roadway.
(3) 
The graded shoulder shall have a uniform slope of 3/4 inch per foot from pavement edge to gutter line.
(4) 
All drainage facilities shall be located at the low point of the graded width.
D. 
Streets. All streets in the Borough shall be constructed in accordance with the following specifications:
(1) 
Subgrade.
(a) 
All rock shall be removed and covered with a six-inch cushion of suitable material meeting the physical, placement and compaction requirements of Section 351 of the Pennsylvania Department of Transportation (PennDOT) Form 408.
(b) 
Preparation of subgrade shall conform to the construction requirements of Section 210 of PennDOT's Form 408.
(c) 
For fine grade, a layer of 2A stone, graded and compressed to four inches in thickness using a ten-ton roller, shall be placed on the prepared subgrade.
(d) 
One-fourth inch per foot crown shall be maintained when fine-grading the subgrade.
(e) 
No stone shall be laid on frozen ground.
(2) 
Base course. The base course shall consist of one bituminous base course with a minimum compacted thickness of five inches on residential streets and six inches on collector streets.
(3) 
Surface courses. The surface course shall not be less than 1 1/2 inches of ID-2 thickness compacted; wearing course compacted with approved power rollers, one weighing not less than 10 tons.
(4) 
Finished streets. All finished streets must maintain 1/4 inch per foot crown, except on super-elevations and area approved by standard engineering practice.
E. 
Curbs.
(1) 
All newly constructed curbs shall be vertical curbs meeting all requirements of this chapter. All existing vertical curbs shall be repaired or replaced with vertical curbs meeting all design and construction requirements of this chapter. All existing rolled curbs which are to be replaced, which are to be reconstructed or which must be substantially repaired shall be replaced with vertical curbs meeting all design and construction standards of this chapter, unless the Borough shall grant an exception, in the sole discretion of the Borough, and it shall be granted only if abutting properties having existing, consistent rolled curb in good condition. The design of vertical curbs shall conform to the vertical curb drawing attached as Exhibit A to this article.[3]

(2) 
Materials and construction requirements for curbs shall be as outlined in the then-current Pennsylvania Department of Transportation Form 408 Specifications.
(3) 
Curb-cut ramps for handicapped persons hall be constructed at crosswalks in accordance with guidelines and criteria contained in Chapter 8, Pedestrian Facilities, of the Pennsylvania Department of Transportation Design Manual, or any such future publications or any regulations adopted by the Pennsylvania Department of Transportation. All curb-cut ramps shall additionally comply with the United States Americans With Disabilities Act and all regulations adopted pursuant thereto.
F. 
Inspections.
(1) 
All work done pursuant to the provisions of this article shall be inspected by the Engineer or the designated Borough official. The costs of such inspections, observation and tests shall be borne by the developer. The following inspections shall be performed either by the Engineer or the designated Borough official:
(a) 
Any street or road started and not completed must be inspected by Borough officials before work is renewed.
(b) 
Any street, road or curb which is not inspected or does not meet Borough specifications will not be accepted by Millersville Borough.
(c) 
After cleaning and grubbing and prior to placement of any embankment.
(d) 
After completion of subgrade and prior to placing any base material.
(e) 
Upon completion of base course.
(f) 
Upon completion of binder course.
(g) 
Upon completing of wearing course.
(h) 
Upon completion of shoulder or drainage work.
(i) 
A final inspection of all items of work shall be completed not more than 10 days prior to dedication of the roadway to the Borough.
(2) 
The contractor shall maintain a duplicate record of inspections, listing the name of the person or persons representing the Borough making an official inspection. List the time, date and nature of comments and any corrective actions requested. A duplicate copy of this record shall be mailed to the Borough office within 10 days of any official inspection.
G. 
Driveways. All driveways used by private or commercial owners shall be constructed in a manner that will not impede or divert the normal flow of surface drainage. All driveways constructed on Borough rights-of-way shall have the same degree of slope as the existing shoulder and in no case less than 3/4 inch per foot with the low point in line with the existing gutter line. Drainage pipe may not be installed under any driveway within the Borough right-of-way, unless written permission and pipe diameter is given by the Borough.
H. 
Requirements for dedication of streets to public use. The Borough will accept into its street system only those streets which have been constructed in accordance with specifications and requirements contained in the Code of Millersville Borough, Borough regulations and resolutions.
I. 
Acceptance of dedication of streets by Borough. Any person who desires to dedicate a street to the Borough shall, at such person's sole cost and expense, provide the Borough with all information and plans necessary for the Borough to process acceptance of dedication. The person offering dedication shall transfer good and marketable title for the street, free of all liens and encumbrances, to the Borough. The person requesting that the Borough accept dedication shall pay all costs associated with such acceptance, including but not limited to preparation of documents, recording costs and advertising costs for the preparation of the ordinance to accept dedication. Nothing in this article shall require the Borough to accept dedication of any street.
J. 
State forms and regulations. Should any forms, specifications and/or regulations of the Commonwealth of Pennsylvania which are referred to in this article be subsequently amended, replaced or in any other way changed, this article shall be automatically amended to incorporate herein the subsequent, similar forms, specifications and/or regulations of the Commonwealth of Pennsylvania.
K. 
Weather limitations.
(1) 
When the air temperature falls below 50° F., extra precautions shall be taken in drying the aggregate, controlling the temperature of the delivered material and compacting the mixture. Bituminous concrete base course, aggregate base course, bituminous binder course, bituminous wearing course and bituminous tack coat shall not be placed on wet surfaces nor when the air temperature is 40° F. or lower, nor when the temperature of the surface on which it is to be placed is 40° F. or lower.
(2) 
Limited tonnage en route to the project when work is terminated for the day because of weather conditions may be placed only with the approval of the Engineer.
L. 
Surface preparation.
(1) 
Proof roll prepared subbase surface to check for unstable areas and areas requiring recompaction. The Engineer shall notify the contractor of unsatisfactory conditions. Do not begin base work until deficient subbase areas have been corrected and are ready to receive base course.
(2) 
On streets where the wearing course will be placed on a bituminous base course or binder course that has been placed several weeks or months previous, the surface shall be cleaned and a tack coat placed on the surface if directed by the Engineer.

A. 
It shall be a violation of this article to undertake construction, reconstruction or repair of any streets, curbs or sidewalks within the Borough or to permit any other person to undertake construction, repair or replacement of any streets, sidewalks or curbs within the Borough in any manner which does not meet all of the standards and requirements set forth in this article. It shall additionally be a violation of this article to commit or to permit any other person to commit any action prohibited by this article.
B. 
Any person who violates or who permits the violation of any provision of this article shall be liable, upon summary conviction thereof, to fines and penalties of not less than $100 nor more than $600 plus all costs of prosecution, which fines and penalties may be collected as provided by law, and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. All fines and penalties collected for violation of this article shall be paid over to the Borough Treasurer. Each day that a violation continues and each section of this article which is violated constitutes a separate violation.[1]

C. 
In addition to institution of a summary proceeding, the Borough may institute proceedings to restrain any violation of or to require compliance with this article.
D. 
The penalties and remedies set forth in this article are in addition to and not in lieu of any fines, penalties or remedies authorized under the law. The existence or exercise of any remedy under this article shall not prevent the Borough from exercising any other remedy provided under this article or under any other Borough ordinance, including but not limited to Chapter 325, Subdivision and Land Development, or available at law or equity.
