The purpose of this chapter shall be to establish rules and regulations
for Town parks, fields and playgrounds, and all administration and enforcement
shall be in furtherance of said purpose.
This chapter shall be known and cited as the "Parks and Playgrounds
Ordinance of the Town of South Berwick."
The Town Manager and the Director of Public Works shall administer this
chapter, and shall have the authority to promulgate rules or regulations not
inconsistent with the provisions of this chapter, or with the laws or regulations
of the state or the United States of America. Such rules and regulations shall
be kept on file in the Town Clerk's office. Any exception to any rules
and regulations shall require written permission from the Town Manager, Director
of Public Works or his/her designee.
Should any section or provision of this chapter be declared by the courts
to be unconstitutional or invalid, such decision shall not invalidate any
other section or provision of this chapter.
This chapter shall not repeal, annul, or in any way impair or remove
the necessity of compliance with any other rule, regulation, bylaw, permit,
or provision of law. Were this chapter to impose a higher standard for the
promotion and protection of health and safety, the provisions of this chapter
shall prevail.
The provisions of this chapter shall govern the boundaries of, and all
areas included therein, in the following Town-owned properties and facilities
("parks and playgrounds"). Additional properties may be included as required
by action and adoption of the Town Council.

A certified copy of this chapter shall be filed with the Town Clerk
and shall be accessible to any member of the public. Copies shall be made
available to the public at reasonable cost at the expense of the person making
the request. Notice of availability of this chapter shall be posted.
This chapter shall take effect and be in force 30 days from the date
of its adoption.
This chapter may be amended by vote of the Town Council by following the procedures set forth in Article
II, Section 11, of the Town Charter.
All titles to the articles and other subdivisions in this chapter are
inserted for convenience only and shall not affect the meaning of the language
in the chapter.
