Bed-and-breakfast facilities within the Charter Township of East China
shall be licensed and regulated so as to protect the health, safety, and welfare
of the Township residents and citizens.
As used in this chapter, the following terms shall have the meanings
indicated:
BED-AND-BREAKFAST
A secondary use which is subordinate to a one-family dwelling unit
in which transient guests are provided sleeping room and board in return for
payment.
TOWNSHIP
The Charter Township of East China.
The Township shall not issue any bed-and-breakfast license to any premises
which is in violation of any applicable law or Ordinance Code provisions,
including County and State Health Department laws.
The following requirements shall be met at all times:
A. Registration. Every owner of a bed-and-breakfast shall
keep a register wherein all guests shall inscribe their names upon their procuring
a room. Said owner shall require identification of each guest as will reasonably
assure that the guest is, in fact, the person under whose name such room is,
in fact, being procured.
B. Length of stay. No guest shall occupy a room for longer
than three continuous days or for more than 30 days during the license year
of the bed-and-breakfast.
C. Conditions.
(1) The owners of a bed-and-breakfast shall only employ or
use the services of family members who are occupying the one-family dwelling
unit where the bed-and-breakfast is located.
(2) Each room occupied by a guest shall have a functioning
smoke detector.
(3) No owner shall allow to be used or use any portable electric,
gas, or oil space heater or any portable unvented space heater fueled by natural
gas, kerosene, alcohol, or other fuel, or wood-burning space-heating units.
(4) No owner shall allow any motorcycle, lawn mower, gas
cans, or anything that contains or has contained flammable liquids to be inside
the structure at any time. Such items may be stored in an unattached garage
or storage building.
(5) All interior hallways shall have at least two exits,
provided that one such exit may be an emergency-type exit or fire escape.
There shall be at least two outside exits from the dwelling unit. All exits
shall be clearly marked.
(6) Each floor of the dwelling shall have at least one approved
and functioning fire extinguisher which is clearly visible and accessible.
(7) All premises shall be kept in a clean condition. All
bedsheets, pillowslips, towels, and washcloths shall be replaced by clean
items before any new guest occupies a room previously occupied by another.
(8) Breakfast shall be the only meal provided guests and
shall be included in the cost charged a guest for occupying a room.
(9) Bathing and lavatory facilities shall be adequate and
available for all guests.
Nothing in this chapter shall be interpreted as permitting operation of a bed-and-breakfast at any location in violation of Chapter
480, Zoning, of the Township Code.
