The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
PARKING LOT
Any outdoor space, plot, lot, parcel, yard or enclosure, or any portion thereof, where more than two motor vehicles may be parked, stored, serviced, housed or kept. "Parking lot" includes but is not limited to the driving and parking areas of drive-in restaurants, drive-in banks, shopping centers, gasoline stations, grocery store parking lots, factory parking lots, and all other parking areas used in connection with the operation of a business. "Parking lot" shall also include Town-owned, -operated and -leased off-street parking lots.
PUBLIC PORTIONS OF A PARKING LOT
The parking areas and the ingress and egress to the parking lot areas designated by the parking lot owners or agents of the owners for off-street parking of automotive or other vehicles, driveways, sidewalks, malls, arcades, service areas and entranceways into stores and buildings.
SHOPPING CENTER
Any combination of retail stores and services contained within one or more parcels of land united to form a general shopping area and upon which site there are located public areas for the nonexclusive use of members of the general public and occupants, visitors and customers of such retail stores and services.

A. 
Definitions. As used in this section, the following meanings shall apply:
DWELLING UNIT
A unit of living area arranged, intended or designed to be occupied by a family or group of not more than five unrelated individuals living together as a single housekeeping unit.
RESIDENT
Any person, firm or corporation who or which lives, resides or pay property taxes to the Town on real estate or on a structure approved for residential occupancy and who or which is the owner of such structure or a tenant therein or who or which can demonstrate some other indication of exclusive right of occupancy.
RESIDENTIAL OVERNIGHT PARKING STREET
A street or portion thereof where curbside parking is limited to vehicles properly displaying a residential overnight parking permit authorized by this chapter. Designated streets will be enumerated in this chapter as amended from time to time by the procedures set forth herein.
B. 
Designation of residential overnight parking streets.
(1) 
The Town Council of the Town of East Greenwich may designate a street or a portion of a street within a residential overnight parking district as a residential overnight parking street upon recommendation of the Town Manager.
(2) 
After advertisement and notice to all landowners whose property abuts the proposed residential overnight parking street, such proposed residential overnight parking street shall be placed on the docket at a regular Town Council meeting. At that meeting, the Council shall render a decision on the designation of the proposed residential overnight parking street, provided that the Town Council makes a finding that it has sufficient information to make such decision.
C. 
Withdrawal of designation. The Town Council may, at any time, on its own motion, withdraw the designation of an existing residential overnight parking street in the same manner that an ordinance is amended. Such withdrawal shall become effective 30 days after Town Council votes thereon. Notice of such action shall also be made by advertisement in a newspaper of general circulation within the Town.
D. 
Erection of signs.
(1) 
Following the Town Council's affirmative vote to designate a residential overnight parking street, parking signs shall be erected on such residential overnight parking street identifying the street or portion of that street which has been so designated.
(2) 
The sign shall inform a vehicle operator that curbside parking on the street is restricted unless the vehicle displays a valid residential overnight parking permit.
E. 
Residential overnight parking permits.
(1) 
Application.
(a) 
Any resident over the age of 16 may apply for a residential overnight parking permit for a noncommercial vehicle by completing an application therefor prescribed by the Town Clerk, which application shall be designed to provide the following information:

The name and residence of the owner of the vehicle.
[2] 
The name, residence and driver's license of the principal operator of the vehicle.
[3] 
The make, model, color and registration number of the vehicle.
(b) 
A driver's license and proof of being a registered voter in East Greenwich or a copy of a lease shall be presented with the application.
(2) 
Upon determination by the Town Clerk that the applicant qualifies for a residential overnight parking permit for the vehicle described in the application, the Town Clerk will cause to be issued a residential overnight parking permit in the form of a sticker or other method prescribed by the Town Clerk. The fee for a residential overnight parking permit shall be per year and payable at the time of submission of the application for the permit.[1]

(3) 
Permits may be issued to automobiles and trucks not greater than 1 1/2 tons.
(4) 
Permits are for personal use of residents living at the address to which the overnight parking permit was issued.
(5) 
The vehicle overnight parking sticker is to be permanently affixed on the rear window, driver side, lower left corner. On station wagons and convertibles, the resident sticker should be permanently affixed on the glass on the left side of the vehicle as far back as possible.
F. 
Effective period and hours or restriction; renewal or transfer of permits.
(1) 
The restriction on parking provided for in this chapter shall be in effect from May 1 through April 30 of the following year from the hours of 1:00 a.m. to 7:00 a.m., except for the third Friday of each month for street sweeping between the hours of 2:00 a.m. to 7:00 a.m.
(2) 
A holder of a valid permit from a previous year shall be entitled to a new residential overnight parking permit for a current year upon payment of the annual fee and submission of evidence to the Town Clerk that the holder still qualifies for the permit.
(3) 
The holder of a valid residential overnight parking permit shall receive a new residential overnight parking permit for the purpose of transferring the same to another qualifying vehicle upon surrender of the holder's existing residential overnight parking permit and completion of a new application or evidence that the parking permit previously issued has been destroyed.
G. 
Use of permits.
(1) 
A parking permit shall not guarantee or reserve a parking space nor shall it excuse the observance of any traffic or parking regulations.
(2) 
No holder of a residential overnight parking permit shall use such permit when such holder no longer fulfills one or more of the applicable provisions of this chapter controlling the issuance of permits.
(3) 
No person shall represent, in any fashion, that a vehicle is entitled to a parking permit authorized by this chapter when it is not so entitled. No person shall cause a parking permit to be displayed on a vehicle which does not qualify for such permit.
(4) 
No person shall duplicate or attempt to duplicate a residential overnight parking permit or display in any vehicle a duplicate parking permit.
(5) 
A parking permit shall not be in effect during a snowstorm parking restriction.
(6) 
Designated residential parking streets. The following streets are hereby designated as residential overnight parking streets, except in areas on these streets in front of driveways, entrances and opposite garage entrances on the other side of the street:

King Street, north side, beginning at point 80 feet from the easterly street line of Main Street, thence running to Marlborough Street; north side, between Marlborough Street and Duke Street; north side, between Duke Street and Crop Street.
(b) 
Marlborough Street, east side, beginning at the intersection of the northerly street line of King Street and the easterly street line of Marlborough Street, running northerly a distance of 190 feet; east side, between King Street and Queen Street; east side, between Queen Street and Long Street; east side, between Long Street and London Street.

H. 
Violations and penalties.
(1) 
No person shall park a vehicle in violation of the residential overnight parking provisions established in this chapter, and any person who does so shall be in violation of this article subject to such fines and penalties as are set forth in the ordinances of the Town of East Greenwich.
(2) 
No person shall use any residential overnight parking permit in a manner contrary to any of the provisions of this chapter. Any person who does so shall be in violation of this article and subject to such fines and penalties as shall be set forth in the ordinances of the Town of East Greenwich.
I. 
Revocation of permits. In addition to the penalties set forth in the ordinances of the Town of East Greenwich, the Town Clerk shall have the responsibility and authority to revoke the residential overnight parking permit of any resident for the abuse of a residential overnight parking permit or for the use of the same in a manner contrary to any of the provisions of this chapter. Revocation of the residential overnight parking permit of a resident or conviction of a resident of a violation of any of the provisions of this chapter shall be considered just cause for denial of a future residential overnight parking permit to such resident.
J. 
Penalty. Violators of this section shall be subject to a fine of $10 for a first offense, $25 for a second offense and up to $100 for subsequent offenses.
Except when necessary in case of an accident to a vehicle or in obedience to traffic regulations or traffic signs or signals, the operator of a vehicle shall not park such vehicle in a roadway other than parallel with the edge of the roadway, headed in the direction of traffic, and with the curbside wheels of the vehicle within one foot of the edge of the roadway.
No vehicle shall stop with its left side to the curb except on a one-way street or in an emergency or to allow another vehicle or pedestrian to cross its way.
It shall be unlawful for any operator or owner of a vehicle to place the vehicle in any street, crosswalk, footpath or sidewalk so as to prevent or obstruct the passing of other vehicles or pedestrians unless for a reasonable time when necessary, but not exceeding five minutes at a time.
It shall be unlawful for the operator or owner of a vehicle to stop, stand or park such vehicle in any of the following places, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign:
A. 
On the roadway side of any vehicle stopped or parked at the edge or curb of a street.
B. 
On a sidewalk.
C. 
Within an intersection.
D. 
On or within 10 feet of a crosswalk.
E. 
Within 10 feet of a point where, if curblines were extended, they would intersect at a street corner.
F. 
In any place where the use of any public or private driveway will be obstructed.
G. 
Alongside or opposite any street excavation or obstruction when such standing or parking would obstruct traffic.
H. 
Within 10 feet of a fire hydrant.
I. 
Upon or within 50 feet of any bridge or other elevated structure upon a highway or within a highway tunnel.
J. 
On any railroad track and within 50 feet of the nearest railroad crossing.
K. 
Within 30 feet upon the approach to any flashing signal located at the side of a roadway.
L. 
At angles in streets and at or near intersections where the standing, stopping or parking of vehicles would obstruct the free movement of traffic and on Main Street immediately south of the intersection with Long Street for a distance of 30 feet, which shall be designated as exclusive parking for Fire Department use.
M. 
Within the area marked and specifically reserved for handicapped parking except for those vehicles displaying handicapped plates issued by the Division of Motor Vehicles. The Chief of Police is authorized to designate and erect signs in those areas reserved for the handicapped.[1]

N. 
Within any area designated as a right-of-way to Greenwich Bay by the Rhode Island Coastal Resources Management Council. The RI CRMC is charged with ensuring that public access to the shore is protected and maintained, per state law. The CRMC has designated six rights-of-way in East Greenwich serving Greenwich Cove. Parking within the following described right-of-way shall be prohibited, and any person found to be parking in said described area shall be in violation of this chapter and subject to such fines and penalties as are set forth herein:

(1) 
"H4" - King Street access at Water Street, located at Map 85, Plat 1, between Lots 91 and 403 and Lot 94.
No vehicle shall remain standing within 10 feet of any white pole or sign indicating a motor bus stop on the side from which passengers board or alight, except that, in lieu of this regulation, the Police Department may where deemed necessary indicate by proper signs spaces which will provide proper access to motor buses at such stops.
A. 
The Chief of Police is authorized to erect signs indicating no parking upon either or both sides of any street adjacent to any school property, public or private, when such parking would, in his opinion, interfere with traffic or create a hazardous situation.
B. 
When official signs are erected indicating no parking upon either side of a street adjacent to any school property, as authorized in this section, no person shall park a vehicle in any such designated place.
C. 
No person shall park a vehicle in any place marked as a school bus loading zone during hours when the provisions applicable to such zones are in effect. The zones are specifically for the use of school buses engaged in the loading and unloading of schoolchildren.
D. 
The driver of a vehicle may stop temporarily at a place marked as a school bus loading zone for the purpose of, and while engaged in, the loading or unloading of passengers, when such stopping does not interfere with any school bus which is waiting to enter or leave such zones.

B. 
If a vehicle remains so parked, after being tagged for an additional consecutive period of time longer than permitted by this section, it shall be considered a second violation. If the vehicle remains so parked after a second violation, and after having been tagged a second time, for an additional consecutive period of time longer than permitted by this section, it may be removed, conveyed by or under the direction of a member of the Police Department by means of towing the vehicle or otherwise to a public garage in the Town. Such removal shall be at the risk and expense of the owner, and before the owner or person in charge of such vehicle shall be permitted to remove the vehicle from the custody of the Police Department, he shall furnish evidence of his identity and ownership or right to possession of and shall sign a receipt for the vehicle and shall pay such towing fees and storage fees as may be reasonably charged by the towing agency or storage facility; provided, however, that a police officer may, in lieu of towing such vehicle to a public garage, serve upon the owner or operator of such vehicle or attach to such vehicle a notice directing the owner or operator thereof to appear at police headquarters of the Town at the time specified in such notice.

A. 
Generally. The following regulations shall apply to any and all Town-owned, -leased, -used or -controlled areas where parking is allowed or regulated, including but not limited to the Town house lot, school parking areas, etc.
B. 
Signs; reserved or restricted spaces. The Chief of Police is hereby authorized to designate by appropriate signage the method and manner of parking and traffic flow on all such areas, and he shall designate reserved and restricted parking as appropriate. No person except those allowed to use restricted or reserved spaces shall be allowed to use such spaces.
C. 
Parking time limit. It shall be unlawful for the owner or operator of any motor vehicle to park the vehicle on any parking areas of the Town for a period of time longer than 48 hours, unless so authorized by the Chief of Police. Whenever any vehicle shall be found parked on the parking lot beyond the period of legal parking time, such vehicle may be removed or conveyed by or under the direction of a member of the Police Department by means of towing the vehicle or otherwise to a public garage in the Town, and such removal shall be at the risk of the owner. To remove the vehicle from the custody of the Police Department, he shall furnish evidence of his identity and ownership or right to possession of, shall sign a receipt for the vehicle, and shall pay the East Greenwich Municipal Court a fee of $30, plus towing charges and storage. It is prohibited to park on any Town property unless otherwise designated. In any prosecution or proceeding under this section, the registration plate displayed on the motor vehicle shall constitute prima facie evidence that the owner of such vehicle was the person who parked such vehicle at the place where such violation occurred. Any violation or failure to comply with the provisions of this section shall be an offense.

D. 
Old Kent County Courthouse parking lot. It shall be unlawful for the owner or operator of any motor vehicle to park his or her vehicle in the Old Kent County Courthouse parking lot for a period of time longer than 30 minutes, Monday through Friday, from 9:00 a.m. through 4:00 p.m. During all other times it shall be unlawful to park longer than three hours unless the owner or operator is present in the courthouse.
E. 
Municipal parking lot. It shall be unlawful for the owner or operator of any motor vehicle to park his or her vehicle in the municipal parking lot on the easterly side of Main Street: for a period of time longer than two hours, Monday through Saturday, from 9:00 a.m. through 6:00 p.m. on the southerly and northerly sides from Main Street to a point 70 feet easterly of Main Street, and for not more than 48 hours from that point to Marlborough Street. Motor vehicle repairs shall not be allowed.

F. 
Municipal Land Trust lots and easements. It shall be unlawful for the owner or operator of any motor vehicle to park his or her vehicle within the area known as the "access easement for the Hunt River Preserve," which is a twenty-five- to thirty-five-foot-wide ingress, egress and utility easement running east from Route 2, beginning roughly across from the Route 4 ramp in the vicinity of 3100 South County Trail. Said access easement is located across Map 17, Plat 17, Lots 272, 274, and 275, leading to the East Greenwich Land Trust parcel located at Map 18, Plat 17, Lot 16. It shall further be unlawful for any owner or operator of a motor vehicle to park in the six-space parking easement to the East Greenwich Land Trust located at the northern side of the described easement area on Map 17, Plat 17, Lot 274, for any period of time longer than two hours, Monday through Sunday, from 7:00 a.m. through 9:00 p.m. The designated parking area is reserved for use by persons utilizing the Hunt River Preserve natural area, and parking for other than that purpose is prohibited.

A. 
The Police Chief is hereby authorized to establish fire lanes on all public property and private property devoted to public use. The designation of such fire lanes shall never be held to make the Town responsible for the maintenance of the fire lanes, but the owner of such property shall continue to be responsible for the maintenance of such area.
B. 
Parking of motor vehicles or otherwise obstructing fire lanes shall be prohibited at all times.
C. 
Upon the designation of a fire lane pursuant to this article, the Police Chief shall give notice of such designation to the owner of such area, directing the owner to cause signs to be posted, at the expense of the owner, at designated locations, lettered "Fire Lane – No Parking Anytime." Such signs shall be of a standard size and color, lettering and mounting, conforming to specifications of the Police Chief.
D. 
The official record of the designation and location of fire lanes shall be kept in the office of the Police Chief.
It shall be unlawful for the owner of any vehicle, except a taxicab, to cause or permit such vehicle to be parked on any street for a period of time longer than two hours between the hours of 1:00 a.m. and 7:00 a.m. of any day.
The Chief of Police is hereby authorized to establish taxicab stands on such streets, in such places and in such number as shall be determined to be of the greatest benefit and convenience to the public, and every such stand shall be designated by appropriate signs. He may revoke, alter or amend any established stand or any assignment to any established stand.
It shall be unlawful for the operator of any vehicle other than a taxicab to park in an officially established taxicab stand. It shall be unlawful for any taxicab to park in any other established taxicab stand than that assigned to it.

The Town Council shall authorize the erection of signs upon any one side of any one-way street to prohibit the standing or parking of vehicles, and when such signs are in place, no person shall stand or park a vehicle upon such side in violation of any such sign.
A. 
The Chief of Police shall designate by proper signs, places not exceeding 100 feet in length in which the stopping, standing or parking of vehicles would create an especially hazardous condition or would cause unusual delay to traffic.
B. 
When official signs are erected at hazardous or congested places as authorized in this section, no person shall stop, stand or park a vehicle in any such designated place.

Whenever a person is charged with a violation of a provision of any ordinance of the Town relating to parking, except the Parking Meter Ordinance, or as otherwise provided in this section, such person may pay to the East Greenwich Municipal Court the sum of $25 for each violation by mail addressed to East Greenwich Municipal Court, 125 Main Street, East Greenwich, Rhode Island 02818, and, upon payment of such amount, a prosecution under this article for the violation in question shall be barred; provided, however, that if the sum of $25 is not paid to the East Greenwich Municipal Court or mailed to the East Greenwich Municipal Court within 14 days after the violation in question, a notice of violation shall be given to the owner of the vehicle in question.
B. 
Whenever a person is charged with a second overtime parking violation, as defined in § 248-35, such person shall pay the sum of $25 to the East Greenwich Municipal Court for each such violation and, upon payment of this amount, a prosecution under this chapter for the violation in question shall be barred; provided, however, that if said sum of $25 is not paid to the East Greenwich Municipal Court or mailed to the East Greenwich Municipal Court within 14 days after the violation in question, a notice of violation shall be given to the owner of the vehicle in question.
C. 
When any such owner shall receive a notice of violation from the East Greenwich Municipal Court in accordance with Subsection A or B of this section, such owner may pay to the East Greenwich Municipal Court the sum of $50 for each violation of Subsection A and the sum of $50 for each violation of Subsection B, or such owner may send the required sum by check, money order or cash for each violation by mail addressed to the East Greenwich Municipal Court, 125 Main Street, East Greenwich, Rhode Island 02818, and upon payment of such amount, a prosecution under this article for the violation in question shall be barred; provided, however, that if the required sum is not paid to the East Greenwich Municipal Court within 28 days after the violation in question, the owner of the vehicle in question shall be brought before the court and prosecuted in accordance with the Town's ordinances.
D. 
Whenever a person is charged with a violation of parking within five feet of any fire hydrant, such person may pay to the East Greenwich Municipal Court the sum of $25 for each violation, or such person may send the sum of $25 by check, money order or cash for each violation by mail addressed to East Greenwich Municipal Court, 125 Main Street, East Greenwich, Rhode Island 02818, and upon payment of such amount, a prosecution under this chapter for the violation in question shall be barred; provided, however, that if the sum of $25 is not paid to the East Greenwich Municipal Court or mailed to the East Greenwich Municipal Court within 14 days after the violation in question, a notice of violation shall be given to the owner of the vehicle in question.
E. 
When any such owner shall receive a notice of violation from the East Greenwich Municipal Court for parking within five feet of any fire hydrant, such owner may pay to the East Greenwich Municipal Court the sum of $50 for each violation, or such owner may send the sum of $50 by check, money order or cash for each violation by mail addressed to the East Greenwich Municipal Court, 125 Main Street, East Greenwich, Rhode Island 02818, and upon payment of such amount, a prosecution under this article for the violation in question shall be barred; provided, however, that if the sum of $50 is not paid to the East Greenwich Municipal Court or mailed to the East Greenwich Municipal Court within 28 days after the violation in question, the owner of the vehicle in question shall be brought before the court and prosecuted in accordance with the Town's ordinances.
F. 
Whenever a person is charged with a violation of a provision of any ordinance of the Town relating to parking, which violation results in the person's vehicle being towed by or at the request of the Town's Police Department, such person may pay to the East Greenwich Municipal Court the sum of $45 for each violation, or such person may send the sum of $45 by check, money order or cash for each violation by mail addressed to East Greenwich Municipal Court, 125 Main Street, East Greenwich, Rhode Island 02818, and upon payment of such amount, a prosecution under this chapter for the violation in question shall be barred; provided, however, that if the sum of $45 is not paid to the East Greenwich Municipal Court or mailed to the East Greenwich Municipal Court within 14 days after the violation in question, a notice of violation shall be given to the owner of the vehicle in question.
G. 
When any such owner shall receive a notice of violation from the East Greenwich Municipal Court in accordance with Subsection F of this section, such owner may pay to the East Greenwich Municipal Court the sum of $90 for each violation, or such owner may send the sum of $90 by check, money order or cash for each violation by mail addressed to the East Greenwich Municipal Court, 125 Main Street, East Greenwich, Rhode Island 02818, and upon payment of such amount, a prosecution under this article for the violation in question shall be barred; provided, however, that if the sum of $90 is not paid to the East Greenwich Municipal Court or mailed to the East Greenwich Municipal Court within 28 days after the violation in question, the owner of the vehicle in question shall be brought before the court and prosecuted in accordance with the Town's ordinances.

Any police officer in uniform, in his discretion, may remove any vehicle left upon any street, not in the apparent charge of any driver or other person and in violation of the provisions of this article, to another place on such street, from such street to some other street, or to a police station, and there leave the vehicle.
The following areas located in the Town are hereby designated as bus stops and are reserved exclusively for the parking of buses: Cliff Street, from a point at the intersection of Cliff Street and First Avenue to a point 28 feet northerly from the intersection.
A. 
It shall be unlawful for the operator of a vehicle to stop, stand or park such vehicle in any place designated as a loading zone place, except for the purpose of loading or unloading merchandise, packages and other articles, providing that such loading or unloading shall be done as expeditiously as possible.
B. 
The following places are hereby designated as loading zone places: Main Street.

It shall be unlawful for the operator of a vehicle to stand or park such vehicle in any place designated in this section as a standing zone for a period of time longer than 10 minutes between the hours of 10:00 a.m. and 10:00 p.m. on Mondays through Saturdays.
B.

The provisions of § 248-35 shall not apply to any place designated by this section as a standing zone place.
A. 
It shall be unlawful for the owner or operator of any motor vehicle to park the motor vehicle on any public street in the Town:
(1) 
At any time during an ice storm;
(2) 
At any time during severe icing conditions; or
(3) 
During any snowstorm after a snowfall of one inch has occurred and during a period of 12 hours after the end of the snowfall of at least one inch.
B. 
Whenever any motor vehicle shall be found parked on any public street in the Town in violation of this section, such motor vehicle may be removed or conveyed by or under the direction of the Chief of Police to a public garage or any other convenient place, provided that the Director of Public Works requests such removal, and provided, further, that the motor vehicle found so parked interferes with the work of removing or plowing snow or removing ice from or controlling ice on the public street. The Chief of Police, within one week after such removal of a motor vehicle, shall give notice thereof to the registered owner of such motor vehicle.
C. 
The owner of any motor vehicle removed as provided in this section may regain possession thereof from the Town by first establishing his ownership of such motor vehicle and paying to the Town Treasurer the sum of $20 for each violation of this section and also paying the cost of removal and reasonable charges resulting from such storage to either the Town Treasurer or the keeper of the place of storage of such motor vehicle. Upon payment of the amount of $20 to the Town Treasurer, prosecution under this section for a violation thereof shall be barred; provided, however, that if the sum of $20 is not paid to the Town Treasurer within seven days after the violation in question, a notice of violation shall be given to the owner of the motor vehicle in question.

D. 
This section shall not apply to state highways in the Town.

Any motor vehicle in violation of any section of this Chapter 248, Vehicles and Traffic, easterly of Main Street between Division Street and Rocky Hollow Road, and on Division Road westerly 1,320 feet from Route 2, shall be towed, and the owner or operator of said motor vehicle shall pay the cost of said tow, plus the violation fee.
