The office of the Town Attorney shall be held by an attorney licensed to practice in the State of Virginia. The Town attorney shall, in conformity with the Towns Charter, serve at the pleasure of the Council and at such compensation as the Council may determine.

A. 
The Town Attorney, in his representation of the Town, shall be paid a salary in an amount as per agreement between the Council and the Attorney, which salary shall be the compensation for those duties as set forth in Subsection B below. For matters requiring the attention of the Town Attorney which fall outside the duties as set forth in Subsection B, the Attorney shall be paid upon the submission of a bill specifying the work done and his fee in consideration thereof. Such fees shall be based on a prearranged agreement between the Town Attorney and Town Council, after the Town Attorney has been authorized to do work other than that set forth in Subsection B.
B. 
The duties of the Town Attorney as prescribed above are as follows:
(1) 
To regularly attend the meetings of the Town Council in the capacity of Town Attorney.
(2) 
To advise the Town Council in regards to legal questions pertaining to the operation of the Town.
(3) 
To regularly attend executive sessions of the Town Council and to limit such executive sessions to appropriate subject matter, unless otherwise advised by Council.

To review the ordinance book and to advise the Town regarding proposed changes therein.
(5) 
To prosecute the Town's misdemeanor cases.
