A. 
A County Planning Commission is hereby created in accordance with the provisions of Code of Virginia, § 15.2-2210 et seq.
B. 
The Commission shall consist of five members. One member shall be appointed from each election district and shall hereinafter be referred to as appointed district members. At least 1/2 of the members of the Commission shall be owners of real property, and all members shall be residents of the county, qualified by knowledge and experience to make decisions on questions of community growth and development.
C. 
The terms of appointed district members shall, beginning January 1, 2003, be concurrent with the term of office of the member of the Board of Supervisors representing that election district.
D. 
Any vacancy in membership shall be filled through appointment by the Board of Supervisors, and such appointment in the case of an appointed member shall be for an unexpired term.
E. 
Any appointed member may be removed by the Board of Supervisors for malfeasance in office, provided that such removal may be made only after a public hearing at which such member is given an opportunity to appear and be heard on the charges against him.
F. 
Each member of the Commission shall be required to take an oath of office before assuming his or her duties.
G. 
All members of the Planning Commission appointed for the first time after September 10, 1997, shall be required to begin the Virginia Certified Planning Commission Program within six months of their appointment and complete the program within 18 months. Failure without just cause of any member to comply with this subsection shall constitute malfeasance in office and grounds for removal from office.

Members of the Planning Commission shall be compensated at a rate as set forth from time to time by the Board of Supervisors. In addition thereto, each member shall be reimbursed his mileage for travel done on business of the Planning Commission at the rate provided by state law.
The County Planning Commission shall prepare a program of work and shall adopt the same after consultation with the Board of Supervisors. Such program of work shall outline the activities in which the Commission expects to engage:
A. 
Assembling such data regarding the County and adjacent territory as such Commission may deem to be necessary in exercising its functions, powers and duties.
B. 
Analyzing such data and making such studies as may be necessary in the preparation of a Comprehensive Plan for the County.
C. 
Preparing such Comprehensive Plan as a general guide for the development of the County and as a basis for the preparation of zoning and other regulations.
D. 
Recommending to the Board of Supervisors appropriate procedures for effectuating such plan.

Pursuant to § 15.2-2217, Code of Virginia, the Planning Commission is hereby authorized to employ a part-time secretary to work in the office 1/2 day each week and to take the minutes at the meetings of the Commission.

Pursuant to § 15.2-2217, Code of Virginia, the Planning Commission is authorized to appoint such employees and staff as it deems necessary for its work and to contract with consultants for such services as it requires, provided that the cost of any and all such appointments and contracts must be within the total funds appropriated by the Board of Supervisors for the operation of the Planning Commission.
The County Planning Commission shall have all the functions, powers and duties which are prescribed by law.[1]
