Deputy Sheriffs of the Warren County Sheriff's Department are hereby
permitted to engage in off-duty employment which may occasionally require
the use of their police powers in the performance of such employment. The
promulgation of reasonable rules and regulations to apply to such off-duty
employment is hereby delegated to the Sheriff of Warren County. Such rules
and regulations are to be filed in the office of the County Administrator
and to be exhibited therein for inspection to any member of the public upon
request therefor.

A.
The County Sheriff is hereby authorized to appoint auxiliary
deputies as he deems necessary, not to exceed the number of 12.
B.
The County Sheriff, with the approval of the Board of
Supervisors, shall establish rules and regulations concerning the operation
of the Sheriff's Auxiliary, including their uniforms, arms and equipment,
and training.
C.
Persons appointed to the Sheriff's Auxiliary shall
be of good character. Their appointment shall be revocable at any time by
the Sheriff or upon a majority vote of the Board of Supervisors.
D.
The Sheriff's Auxiliary may be called into service
as deemed necessary by the Sheriff or, in times of public emergencies, by
the County Director of Emergency Services. Said Auxiliary may also be called
into service at such times as there are insufficient numbers of regular Sheriff
Deputies to preserve the peace, safety and good order of the county and at
any time for the purpose of training.
E.
When called into service, the auxiliary deputies shall
wear the prescribed uniform and shall have all the powers and authority and
all the immunities of constables at common law and shall have all of the power
and authority and all of the immunities of full-time law enforcement officers
if all work forces have met the training requirements established
by the Department of Criminal Justice Services, under § 9-170 of
the Code of Virginia, 1950, as amended, or its successor statute.
F.
Persons appointed to the Sheriff's Auxiliary shall
serve without compensation. The Auxiliary may be permitted to conduct certain
fundraising activities for the mutual benefit of said Auxiliary as permitted
by the Board of Supervisors.
G.
Persons appointed to the Sheriff's Auxiliary may
not engage in employment which may occasionally require the use of their police
powers in the performance of such employment unless such employment is specifically
approved by the Board of Supervisors. The Director of Emergency Services,
upon the recommendation of the Sheriff, may grant such approval when deemed
necessary to protect the public safety. Such approval shall be valid only
until the next regularly scheduled meeting of the Board of Supervisors at
which time the Board shall act on the matter.
