[HISTORY: Adopted by the Common Council of the City of Burlington 1-7-1992 by Ord. No. 1372(39); amended in its entirety at time of adoption of Code (see Ch. 1, General Provisions, Art. II). Subsequent amendments noted where applicable.]
A. 
Any person, partnership, limited liability company or corporation wishing to use the geographical designation "Chocolate City USA" and the accompanying logo shall file an application for a license with the City Clerk, who shall schedule the application for consideration by the Common Council.
B. 
If the Common Council determines that the business is an appropriate business for the use of the geographical designation and logo as part of the business' trade name, the Common Council may, by resolution, grant the applicant the right to use the geographical designation and logo for a period of three years. The resolution shall not be effective until the applicant's execution of a licensing agreement and payment of the license fee set forth in Subsection F.
C. 
Said license shall not be granted to more than one business of a similar kind as determined by the Committee of the Whole.
D. 
The licensing agreement shall be in a form approved by the City Attorney.
E. 
The City Clerk shall keep a list of all individuals and businesses granted a license to use the geographical designation and logo and shall certify to the Committee of the Whole upon the expiration or cancellation of any such license.
F. 
The fee to be paid for granting of said license hereunder shall be as set by the Common Council.[1]

Any person, partnership, limited liability company or corporation wishing to use the "Chocolate City USA" logo as an adjunct to an unrelated trade name shall file an application with the City Clerk, who shall schedule the application for consideration by the Common Council.
B. 
If the Common Council determines that the use of the logo by the business is likely to promote the City of Burlington, the Common Council may, by resolution, grant the applicant the right to use the logo only for specified uses, which may include the applicant's equipment, place of business, business correspondence, or a similar use, for a specified time period. The resolution shall not be effective until the applicant's execution of a licensing agreement and payment of the license fee set forth in Subsection F.
C. 
Said license may be granted to as many businesses of the same nature as are likely to use the logo to promote the Burlington area.
D. 
The licensing agreement shall be in a form approved by the City Attorney.
E. 
The Clerk shall keep a list of all individuals and corporations granted a license to use the "Chocolate City USA" logo and shall certify to the Committee of the Whole upon the expiration or cancellation of such license.
F. 
The fee to be paid for granting said license hereunder shall be as set by the Common Council.[1]

A. 
Any person using the geographical designation or logo, either in a trade name or on its equipment unrelated to its trade name, shall be allowed to continue its use for a period of three years without fee.
B. 
At the end of that three-year period said individual or business shall have to file an application with the Committee of the Whole and pay the fee required for the applicable license.
In addition to the suspension or revocation of any license or permit issued under this chapter, any person who shall violate any provision of this chapter shall be subject to a penalty as provided in Chapter 1, § 1-4 of this Municipal Code.
