A. Household solid waste. All residences located in any
area in which refuse collection is done by the City or approved contractors
shall have sufficient container capacity to accommodate their normal
volume of solid waste between collections. All refuse shall be collected
from every residential dwelling of four units or fewer at least once
per week. Residential units developed within a commercial development
shall be considered commercial. Refuse and recyclable material are
to be collected from the residences at the street curb or behind residences
where City alleys exist.

(1) Refuse containers and recycling bins.
(a)
Only plastic bags and standard garbage cans with a maximum volume of 30 gallons may be used for refuse. The maximum weight of any full refuse container shall be 60 pounds. Material that must be recycled and placed in the designated recycling bin pursuant to Article
III, Recycling, shall be placed in bins provided by the City or by the owners or agents of the property.
(b)
All containers are to be kept in areas of easy
accessibility, with a path to the containers to be kept clear of snow,
cars and other obstacles.
(c)
Refuse or recyclable material that has been
scattered by wind, animals or vandals is the responsibility of the
resident.
(2) Collection dates. Dates for collection will be assigned
to each residence or established by the Common Council and will be
on a regular schedule except in weeks with a holiday. The observed
holidays are New Year's Day, Memorial Day, Independence Day, Labor
Day, Thanksgiving Day, and Christmas Day. The rule for holidays is
that collection normally occurring on the above holidays will be delayed
to the next regular day of collection. (For example, if the holiday
occurs on Monday, the observed holiday is Monday and collection will
occur on Tuesday.)
(3) Collection times. No containers shall be placed at
curbside or, if picked up in the alley, at the alley's edge prior
to 12 hours of collection day, and containers shall be removed within
12 hours after collection. The collection of solid waste will be made
during the hours of 7:00 a.m. to 5:00 p.m. Changes to the current
routing may be implemented upon prior approval by the City. Solid
waste and recyclables will be set within five feet of the edge of
the road by 7:00 a.m. to assure pickup.
(4) Household solid waste includes the following items
with these established rules for collection:
(a)
Major appliances. Major appliances, including
appliances containing Freon, reasonably generated at the residence
will be collected on a reasonable basis. Such pickup requires special
handling by the collection contractor, and prior arrangements for
collection must be made by the resident through the office of the
collection contractor.
(b)
Tires. Tires will be collected curbside pursuant
to a user pay program. Pickup fees will be collected on delivery,
with the resident being charged for pickup according to the payment
schedule provided by the contractor.
(c)
Furniture and building materials. Collection
shall include the collection of televisions, couches, furniture, tables,
other large items, building materials and any other items manageable
by one person and not banned from landfill disposal as described by
state law. Small quantities of building materials (lumber, plasterboard,
etc.) shall be accepted by the collection contractor if placed in
standard garbage cans and if the weight per container does not exceed
60 pounds. Lumber must be cut in lengths not exceeding four feet.
(Loose building materials shall not be subject to collection hereunder.)
(d) "Household solid waste" is limited to the above items as are generated
at the residence by typical residential uses, not by any off-site
operations, any business operation, or any other nontypical residential
use.

B. Ammunition. A person shall not dispose of unwanted
ammunition in garbage or trash pickup but can take such unwanted ammunition
to the Police Department for proper disposal.
C. Household hazardous materials. All household hazardous
materials, such as weed killers, paint thinners, gasoline, etc., shall
not be deposited into normal refuse collection.
D. Persons
who may collect rubbish and refuse.

(1) In
an area with residences in which refuse collection is done by the
City or by City-approved contractors, no person, unless she/he has
a contract with the City of Burlington permitting him/her to collect
and remove rubbish and refuse, or unless he/she is a City employee
acting under the direction of the Common Council, shall collect or
remove any rubbish or refuse which has been deposited or placed by
any person at curbside, or at the alley's edge where a City alleys
exists, adjoining his/her premises for collection by the City as herein
provided. "Person" as used in this section includes individuals, partnerships,
associations, and bodies politic or corporate.
(2) Notwithstanding
the above, residents may retrieve their own rubbish, refuse, or bulky
items at any time prior to collection.

A. Applicability. This section shall apply to all persons and entities
who or which, directly or through the services of the City of Burlington
or another third party, dispose of or attempt to dispose of solid
wastes at any City-owned landfill, compost site, or City right-of-way,
including all persons, governmental operations and business, commercial,
retail and industrial enterprises however organized and of whatever
type.
B. Prohibited yard waste disposal. No person shall:
(1) Mix or permit the mixing of yard waste with solid waste for City
curbside garbage collection or place or permit the placing of yard
waste out for City curbside garbage collection.
(2) Deposit yard waste at any authorized yard waste or compost site while
the site is closed.
(3) Deposit grass clippings, garden debris, stumps, roots or shrubs with
intact root balls in or upon any public street or waterway in the
City of Burlington.
C. Permitted yard waste disposal. It shall be lawful to:
(1) Deposit yard waste at any authorized City of Burlington compost sites
while such authorized sites are open in accordance with the rules
and regulations promulgated by the Public Works Director and approved
by the Common Council without charge.
(2) Deposit leaves at curbside to be collected by the City during a fall
collection of leaves if such property is eligible to be served by
regular City garbage collection in accordance with the rules and regulations
promulgated by the Public Works Director and approved by the Common
Council.
(3) Deposit brush behind the curbside no earlier than three days before
scheduled brush pickup.
D. Contractor services.
(1) All contractor services must include the removal of brush and yard
waste, except leaves, generated as a part of their work. The City
will not be responsible for removing any contractor-generated material
from City rights-of-way with the exception of leaves from properties
served by regular City garbage collection.
(2) All property owners within the City of Burlington not served by regular
City garbage collection may drop off yard waste for a fee at the compost
site during scheduled hours of operation. The said fee shall be established
from time to time by a resolution(s) adopted by the Common Council.
E. Owner responsibility. Every owner or operator shall be responsible
for maintaining all property under his control in accordance with
the requirements of this section.
F. Penalty. Any person who violates any provision of this section shall be subject to forfeiture per occurrence. Each day a violation continues shall be considered a separate offense. A penalty shall be imposed pursuant to §
265-2 of this chapter.

A. Household sharp medical waste shall not be deposited
in any other place or manner in the City of Burlington other than
as hereinafter provided.
B. Acceptable means of disposing of household sharp medical
waste shall be limited to depositing said waste at the City of Burlington
Fire Department at hours specified by the Department and in the containers
supplied. Household sharp medical waste shall be deposited in the
manner prescribed by the Fire Chief.
C. It shall be unlawful to deposit household sharp medical
waste in any manner with household or commercial garbage.
D. No container for household sharp medical waste or
loose household sharp medical waste may be mixed with recyclables.
E. Any person who shall violate any prohibition of this section, including the placement of household sharp medical waste contrary to the provisions of this section, shall, upon conviction thereof, be subject to the penalties set forth in Chapter
1, §
1-4, of this Municipal Code. Each day or incident of violation shall be deemed a separate offense. In addition to or in lieu of the penalty provided herein, the court may order the violator to clean up, remove and pay the costs of cleanup or removal of any garbage or rubbish placed in violation of this section and pay for the cost of all medical care necessary should an injury be caused by the improper disposal of household sharp medical waste.
