§ 257-1 Authority.

This chapter is adopted under the authority granted by § 23.33(11) and (13), Wis. Stats.

§ 257-2 Title.

This chapter shall be known as, referred to, or cited as the "Green Lake County All-Terrain Vehicle (ATV) Ordinance."

§ 257-3 Jurisdiction.

This chapter shall regulate the operation of all all-terrain vehicles in all areas of Green Lake County.

§ 257-4 Adoption of statutory provisions.

Pursuant to the authority granted to local authorities in § 23.33(11), Wis. Stats., Green Lake County does hereby adopt the provisions of § 23.33, Wis. Stats., and the same are by reference made a part of this chapter as if fully set forth herein.

§ 257-5 Definitions.

The definitions of words and phrases as they appear in § 23.33(1), Wis. Stats., are hereby adopted and by reference are made a part of this chapter as if fully set forth herein.

§ 257-6 Violations and penalties.

Any person violating any provision of this chapter shall, upon conviction, forfeit a dollar amount not to exceed the maximum dollar amount of the forfeiture provided in the subsection(s) of Wisconsin Statutes violated, together with all applicable costs, and in default of payment of such forfeiture and costs shall be confined in the Green Lake County Jail until such forfeiture and costs are paid, but not to exceed 30 days.

§ 257-7 Stipulation of guilt or no contest.

Stipulations of guilt or no contest may be made by persons issued a citation for violation of this chapter. Stipulations shall conform to the requirements of § 345.27, Wis. Stats., and may be accepted together with the required forfeiture, assessments and costs within the number of days from the date of the alleged violation as appears on the uniform traffic citation and complaint issued to the alleged offender. A stipulation of guilt shall be in a form approved by the Circuit Court Judge of Green Lake County, and the forfeiture shall be as provided in a schedule of penalties established by said Judge.

§ 257-8 Use of trails.

All-terrain vehicles shall be operated only on trails developed and designated specifically for their usage. All-terrain vehicles shall not be allowed on trails developed, designated and maintained for use by snowmobiles, bicycles or hikers. Violations of this section shall be punished by a fine of not less than $25 nor more than $250 plus assessments and costs and full restitution for any damages caused said trails.

§ 257-9 Areas open to operation.

The following areas are open to ATV operation:
Private property, either by the owner(s) of said property or with the permission of such owner(s).
Designated ATV trails and public accesses thereto.
Public lands, subject to the restrictions of § 23.33, Wis. Stats., and § 257-8 above.
Frozen public waters, subject to the restrictions of § 23.33, Wis. Stats.

§ 257-10 Enforcement.

The Green Lake County Sheriff's Department shall enforce the provisions herein. The District Attorney shall, upon receipt of a complaint from the Sheriff's Department, institute appropriate legal proceedings against alleged offenders.
