§ 1-27 Adoption of citation enforcement procedure.

To expedite the resolution of ordinance violations, the County Board of Supervisors of the county adopts the citation enforcement procedure authorized by § 66.0113, Wis. Stats., to enforce those ordinances identified in § 1-29, including those ordinances for which a statutory counterpart exists.

The adoption herein of the citation method of enforcement shall not preclude the county or officers authorized to issue citations under this article from proceeding under any other enforcement ordinance, regulation, statute, law, rule or order that pertains to the subject matter addressed by the citation or to any other matter. Proceedings under any other ordinance, statute, law, rule or regulation pertaining to that or any other matter shall not preclude the issuance of a citation.

Unless otherwise specified in the adopting resolution, all ordinances without a statutory counterpart adopted subsequent to this article shall be enforced by the citation method, provided that the County Board shall, in conjunction with enacting any such ordinance, establish a cash deposit for the violation, unless the Board shall decide to enforce the ordinance other than by the citation method. The deposit set for each new ordinance shall be incorporated by reference to the schedule contained herein. The provisions of Subsection B of this section shall apply to all new ordinances.

§ 1-28 Legal effect; payment of deposit.

The citation shall have the legal effect specified in § 66.0113, Wis. Stats., and a duly issued citation shall confer subject matter jurisdiction upon the Circuit Court for the county.

A person issued a citation under any ordinance listed in the schedule shall be required to remit the amount provided for therein, in cash or by certified check or money order, to the Clerk of Court at the Pierce County Courthouse, Ellsworth, Wisconsin, 54011. The Clerk shall provide a receipt for each cash deposit so received. Cash deposits may be mailed to the Clerk of Court or delivered personally to the office of the Clerk of Court.

§ 1-29 Cash deposits and assessments.

The following schedule of cash deposits is established for use with citations issued under this article. The total of each deposit shall include a forfeiture, the penalty assessment under § 757.05, Wis. Stats., the jail assessment under § 302.46(1), Wis. Stats., any applicable domestic abuse assessment imposed under § 973.055(1), Wis. Stats., the crime laboratories and drug law enforcement assessment imposed under § 165.755, Wis. Stats., and any applicable consumer information assessment imposed under § 100.261, Wis. Stats.

§ 1-30 Procedure on default.

The provisions of § 66.0113(3), Wis. Stats., on the violator's options and the procedure on default are adopted.

§ 1-31 Persons authorized to issue citations.

Any law enforcement officials employed by Pierce County may issue citations for the enforcement of any ordinances authorized under this article.

In addition, each of the following County officials may issue citations for the violation of ordinances directly related to his or her official responsibilities: Pierce County Solid Waste Operations Manager, Pierce County Zoning Administrator, Assistant Zoning Administrator, Pierce County Land Management Director/Land Use Coordinator, Zoning Specialist, the Pierce County Public Health Director, Local Health Officer, Environmental Health Specialist, Land Conservation Supervisor, Conservation Engineering Technician, Soil Conservationist, Pierce County Parks Superintendent and park personnel delegated authority by the Pierce County Parks Superintendent.

In the event that the position of Solid Waste Operations Manager, Zoning Administrator, Assistant Zoning Administrator, Land Management Director/Land Use Coordinator, or Zoning Specialist is vacant, his or her authority under this article may be assumed by the Land Management Department and/or solid waste management personnel designated by the Land Management Committee and/or Solid Waste Management Board.

In the event that the position of Public Health Director or Environmental Health Specialist is vacant, his or her authority under this article may be assumed by personnel designated by the Board of Health.

In the event that the position of Land Conservation Supervisor, Conservation Engineering Technician, or Soil Conservationist is vacant, his or her authority under this article may be assumed by Land Management Department personnel designated by the Land Management Committee and the Land Conservation Committee.

The official named in Subsection B may submit to the County Board written nominations of employees within his office who should be delegated authority to issue citations for violations of ordinances related to his official responsibilities. If the nominations are affirmatively approved by vote of the County Board, the persons so named shall have authority to issue citations with respect to ordinances directly related to their responsibilities.

Citation issuance authority may be revoked in the same manner in which it was conferred.

Citations authorized by this article shall conform to the requirements of § 66.0113, Wis. Stats., as amended from time to time, and shall be on forms approved by the governing committee of each department supervising enforcement activity and by the Corporation Counsel and shall be placed on file in the office of the Corporation Counsel.
