GENERAL REFERENCES

The purpose of this chapter is to create regulations pertaining to the installation of satellite dish antennas (SDA) in the Village of Westfield. These provisions are created to promote the safety and general welfare of the citizens of the Village and to enhance the environmental aesthetics of the Village.
A. 
Permit. An application for a permit to install an SDA shall be made in writing to the Village Clerk-Treasurer who in turn shall submit it to the Zoning Administrator for inspection and approval or disapproval. The application must be accompanied by a nonrefundable fee as set by the Village Board and a complete set of plans and specifications of the proposed SDA and the proposed installation. This includes a plot plan showing the location of the SDA (including measured distances) with respect to adjoining alleys, streets, lot lines and structures and location of connecting underground lines (§ 412-4 below). An SDA may be installed only on a residential property.
B. 
Maintenance and repair. Any condition of an installed SDA which may result in danger to life or property or which is in need of maintenance or repair, as determined by the Zoning Administrator, shall be corrected within five days from the date of written notice from the Zoning Administrator to the owner of the SDA. If the specified condition is not corrected within the prescribed five days, the owner shall be subject to the penalty provided in Chapter 1, § 1-3 of this Code. Each day such a violation exists shall be considered a separate offense.[1]

C. 
One SDA. There shall be no more than one SDA installed on any given residential parcel.
D. 
Interference. A permit to install an SDA is issued on the condition that it not interfere with radio and/or television reception on adjacent properties. If such interference subsequently occurs, the owner will be required to dismantle the SDA.
E. 
Advertising. An installed SDA may not be used for the purpose of advertising.
F. 
Except for Subsection E above, the provisions of this chapter do not apply to satellite dish antennas two feet in diameter or less.

A. 
Maximum diameter shall be 10 feet.
B. 
A portable or trailer-mounted SDA may only be used for demonstration purposes, not to exceed 30 days, at the site of a proposed permanent installation.
An SDA must be installed in accordance with the following specifications. All electrical lines, cables and conduits running to a permanently installed SDA must be underground and identified on the permit application. The SDA:
A. 
May only be located in the rear yard of a residential lot and must conform to the following yard requirements:
(1) 
R-1 Single-Family Residential District.
(a) 
Rear yard: 25 feet minimum.
(b) 
Side yard: five feet minimum.
(2) 
R-2 Single-Family Residential District.
(a) 
Rear yard: 20 feet minimum.
(b) 
Side yard: five feet minimum.
(3) 
R-3 Multifamily Residential District.
(a) 
Rear yard: 20 feet minimum.
(b) 
Side yard: five feet minimum.
B. 
May not be attached to or erected on any residential building, or any structure accessory thereto.
C. 
Shall not exceed a total height of 15 feet above ground, measured at ground level.
An SDA must be installed in accordance with the following specifications:
A. 
B-1 General Commercial.
(1) 
Yards:
(a) 
Rear: five feet minimum.
(b) 
Sides: five feet minimum.
(c) 
Street: 10 feet minimum.
(2) 
Roof mount:
(a) 
Only mesh satellite dish antennas may be mounted on rooftops or attached to buildings.
(b) 
The SDA shall not exceed a total height of 17 feet above the roof.
(3) 
Detached ground mount:
(a) 
The SDA shall not exceed a total height of 15 feet above the ground.
(b) 
All electrical lines, cables and conduits running to a permanently installed SDA must be underground and identified on the permit application.
B. 
B-2 Highway Commercial.
(1) 
Yards:
(a) 
Rear: 50 feet minimum.
(b) 
Sides: 20 feet minimum.
(c) 
Street: 20 feet minimum.
(2) 
Roof mount:
(a) 
Only mesh satellite dish antennas may be mounted on rooftops or attached to buildings.
(b) 
The SDA shall not exceed a total height of 17 feet above the roof.
(3) 
Detached ground mount:
(a) 
The SDA shall not exceed a total height of 15 feet above the ground.

All electrical lines, cables and conduits running to a permanently installed SDA must be underground and identified on the permit application.
C. 
B-3 Residential Commercial.
(1) 
Yards:

Sides: 10 feet minimum.

Street: 25 feet minimum.
(2)

Any installed SDA existing on the effective date of this chapter is exempted from all provisions of this chapter except § 412-2B, C and E.
