At the first meeting of each year, there shall be appointed by the mayor, by and with the consent of the majority of the City council a clerk, treasurer, chief of police, City engineer, attorney, director of public works director, planning and development director and municipal judge. In addition, the mayor may at any time appoint with the consent of the majority of the City council other City officers including but not limited to, an economic development director, urban development director, administrative assistant, City administrator, director of administrative services and any necessary department heads, assistants or deputies.

Each appointed officer shall hold office until the first regularly scheduled meeting of the governing body held in January, of each year; provided, that for inefficiency, incompetency, neglect of duty or maladministration of office, any appointee may be sooner removed by the mayor, the majority of the City council concurring. Should a vacancy occur in any such office the new appointment shall be only for a period to complete the unexpired term.
Each person appointed to any office under this Code or other ordinances of the City shall, before entering upon the performance of the duties of such office, subscribe an oath or affirmation to honestly and faithfully perform and discharge the duties of such office to the best of his ability. In addition thereto, certain officers shall be required to furnish bonds in accordance with Article V of this chapter.

A. 
Compensation and salaries of all appointed officers and other employees of the City shall be fixed by the mayor and City council and shall be commensurate with the qualifications of the person appointed and the duties of the employment to be performed.
B. 
In the absence of a specific employment contract, appointed officers shall be entitled to receive the benefits set forth in Article III of Personnel Policy Manual.

The duties of the City treasurer shall be as follows:
A. 
To receive all money derived for the benefit of the City, from every source, in each instance giving his official receipt therefor.
B. 
All warrants drawn upon the treasurer must be signed by the mayor and countersigned by the clerk, stating the particular budget line item to which chargeable, the person to whom payable and the purpose thereof.
All such warrants shall be drawn only upon the direction of the City council after the issuance of an approved purchase order. No warrant shall be drawn unless there exist sufficient funds in the budget line item to which it is chargeable.
C. 
To keep permanent, accurate and complete accounts and records of all receipts, orders and warrants.
D. 
If, at any time, any orders and warrants are not paid for lack of funds, the City treasurer shall endorse the date of presentation and the reason for nonpayment across the back thereof; and the holder of such order or warrant shall be entitled to receive interest thereon, at the rate of six percent per annum, from such date until paid.
E. 
The City treasurer shall endorse upon or attach to every bond or other evidence issued by the City pursuant to law a certificate that the same is within the lawful debt limit of the City and is issued pursuant to law. He shall sign such certificates in his official capacity.
F. 
The City treasurer shall, at the end of each quarter and as often as required, render an account to the City council, under oath, showing the state of the treasury at the date of such account, the amount of money remaining in each fund, the amount paid therefrom and the balance of the money in the treasury; he shall also accompany such accounts with a statement of all receipts and disbursements, together with all warrants redeemed and paid by him.
G. 
The City treasurer shall prepare and compile, with the assistance of the mayor and City council and City officers, the annual budget as required by state law.
H. 
The City treasurer shall also perform such other duties as may be required of him by the mayor or City council or by law.
The duties of the City clerk shall be to:
A. 
Safely keep the corporate seal, papers, records and books belonging to the City.
B. 
Attend the meetings of the City council, recording the minutes thereof, which minutes, after approval at each meeting, shall be signed by the mayor, attested by the City clerk and have the City seal affixed.
C. 
Preserve a consecutive record of all resolutions and ordinances passed by the council, promptly filing with each City department copies of any ordinance which may be of concern to such department. He shall also promptly file with the mayor a complete record of the titles of all ordinances, when the same are passed, and an exact copy of each governing ordinance or ordinance requiring law enforcement.
D. 
Attest the signature of the mayor and affix the seal of the City to all minutes of council proceedings, all resolutions and new ordinances passed, all bonds and business licenses issued and such other documents as shall be required.
E. 
Attest all orders and warrants upon the City, keeping an accurate, permanent record thereof.
F. 
Keep a record of all outstanding bonds against the City, showing the number and amount of each, for and to whom such bonds were issued, and when any bonds are purchased, paid or cancelled. Such record shall show the fact, and in his annual report he shall describe particularly the bonds issued and sold during the year and the terms of sale, with each item of expense thereof.
G. 
Issue business licenses in accordance with this Code and other City ordinances and issue cemetery certificates and permits.
H. 
Perform such other duties as may be required of him by the mayor or the City council, or by law.
The duties of the City attorney shall be to:
A. 
Commence, prosecute and defend all suits to which the City is a party, in all courts of the City and state.
B. 
Prosecute all suits for the violation of any provision of this Code or other City ordinance.
C. 
Give his advice to the mayor and any member of the City council on legal questions arising relating to the business of the City.
D. 
Draw all contracts to which the City is a party.
E. 
Revise all ordinances prior to their final passage by the council.
F. 
Draft and prepare all ordinances when so requested by the mayor or any member of the City council.
G. 
Attend the meetings of the council.
H. 
Do all legal work relating to the City's business and perform such other duties as may be required of him by the mayor or the City council or by law.
A. 
The duties of the City engineer shall be to:
(1) 
Prepare maps, estimates, etc., when needed, or at the request of the mayor or City council.
(2) 
Make all surveys and establish grades for streets, sidewalks, curb and gutter and sewer installations.
(3) 
Inspect the materials and workmanship of all curb and gutter and similar installations, supervise all such construction and require the same to conform with certain specifications to be furnished by his office.
(4) 
Issue such permits, when applied for, as may be authorized under this Code or other ordinances, or with the approval of the council in accordance with the provisions thereof.
(5) 
Perform such other duties as may be required of him by the mayor or City council or by law.
B. 
The City engineer may delegate such of his powers or duties as will render the maximum of service and efficiency in his department to any of his assistants.
The duties of other appointive officers shall be as set forth under this Code or other ordinances pertaining to their respective departments.
The officers responsible therefor shall cause to be kept, for all City departments, including water, electrical, park, streets and alleys, and all other municipal departments, accurate records of all the time worked by all laborers employed in their various departments and shall file such payroll records with the City treasurer not later than the last day of each month.
