The Board of County Commissioners of Doña
Ana County has the general control and management of all roads, highways,
bridges, and streets within unincorporated subdivisions and communities,
with the exception of such roads, highways, and bridges as are declared
by the State Highway Commission to be state highways or bridges and
roads, as set forth in NMSA § 67-2-1 et seq.

A. It shall be mandatory for all persons to obtain a grading permit from the County Engineering Department prior to any road construction within an existing or proposed County road. All necessary permits, if any, from other governmental entities must also be acquired before construction. Said permits include, but are not limited to, curb and gutter, driveways, pavement construction, storm drainage, structures, signing, lighting, utilities, or any other work within the County road right-of-way. B. There shall
be a minimum fee of $20 charged for all grading permits.
Grading permits over a construction cost of
$2,000 will be based on 1% of the construction cost within the road
right-of-way. The fee will cover the permit, plan checking, and inspection
and will be available at the Road Department. The County Road Department
will pay for all lab tests required.
