A. 
The Doña Ana County Treasurer's office incurs costs in processing various transactions such as collecting for returned personal checks and providing special services for private businesses.
B. 
It is customary to collect a reasonable fee for the additional work necessary to perform these transactions as allowed by New Mexico State statute.
A. 
The personal property tax sale is authorized by NMSA §§ 7-38-53 through 7-38-59 for the purpose of extinguishing delinquent property taxes on personal property, penalties and interest due.
B. 
The County Treasurer is authorized to recover any cost incurred in preparing for such personal property tax sale. (NMSA § 7-38-58)
Fees set forth in § 179-26 shall be disposed of as follows:
A. 
The fees for § 179-26A and H are dedicated to the General Fund.
B. 
The fees for § 179-26B through G are dedicated to the County Treasurer Fees Fund for employee training and equipment purchase.
The County Treasurer is hereby empowered to recover the following administrative fees for the Treasurer's office:
A. 
Returned checks - NSF: $25 each.
B. 
Tax roll tape for businesses: $150 each.
C. 
Delinquent real property state list: $50 each.
D. 
Copy of check: copying fee of $0.40 plus a look-up fee of $4.60, for a total of $5 per check copy.
E. 
Tax account research on behalf of mortgage companies: base fee of $10 for up to 10 accounts; $0.50/account thereafter.
F. 
Mortgage company payment errors to be corrected: $10/account.
G. 
Demand warrants service fee: $25 each.
H. 
Sale preparation fee to cover expenses for preparing mobile home for auction (NMSA § 7-38-58); imposed and owed after owner fails to pay or reneges on installment payment contract after being served with the demand warrant: $150/mobile home.
The County Treasurer may increase or decrease these fees as necessary in response to changes in state statutes or economic factors.
