A. 
Article IV of the Pennsylvania Municipalities Planning Code ("MPC") authorizes the Board of Supervisors to, by ordinance, adopt an Official Map for the Township designating, inter alia, existing and proposed public streets; watercourses and public grounds; existing and proposed public parks, playgrounds, and open space reservations; pedestrian ways and casements; and flood control and stormwater management areas and easements. The Board of Supervisors adopted a Comprehensive Plan which recommends the preservation of many of the above-listed natural features, the development of a new collector street, and the adoption of an Official Map. The Board of Supervisors desires to adopt an Official Map to implement the Comprehensive Plan.
B. 
The Board of Supervisors intends to amend the Township Subdivision and Land Development Ordinance to require that all developments be designed in accordance with the Official Map as authorized by Sections 503(2)(i), 503(2)(iv) and 503(11) of the MPC.[1] This will promote coordinated development, especially as it relates to the proposed collector street, and will inform developers where open space required in connection with a subdivision or land development should be located. The Board of Supervisors also intends to amend the Zoning Ordinance to require that certain items shown on the Official Map be considered in the use and future development of land in order to provide for the protection of natural resources as specifically authorized by MPC Sections 603(f)(2) and 604(1).[2]

C. 
It is the intent of the Board of Supervisors, to the maximum extent feasible, to use the Official Map as one of many tools to implement the Comprehensive Plan. The Board of Supervisors intends that the Official Map be notification to landowners of the policies of the Comprehensive Plan and the manner in which the Board of Supervisors seeks to implement those policies.
All terms defined in Section 107 of the MPC[1] shall have the definitions set forth therein unless modified by this section. All terms set forth in this section shall have the meaning indicated:
COMPREHENSIVE PLAN
The Hellam Township Comprehensive Plan Update dated March, 2002, prepared by C.S. Davidson, Inc., and adopted by Resolution No. 2002-15 on May 16, 2002.
CONTINUOUS CANOPY WOODLAND CORRIDOR RESERVATION
A prohibition on the removal of more than 20% of the trees with a diameter in excess of six inches measured at a height four feet above the ground nor more than 20% of the total area, unless such tree is diseased or has been damaged by weather or other natural causes, may be removed. Any area on the Official Map identified as a continuous canopy woodland corridor reservation cannot be timbered nor have more than 20% of the trees existing on the date of enactment of this chapter removed for any purpose, including but not limited to the erection of structures, unless the landowner files a mitigation plan with the Township and follows all provisions in Article IV of the MPC.[2] The Board of Supervisors intends woodland reservations to preserve open space and natural features and resources within the Township. The Board of Supervisors also intends woodland reservations to encourage the recharge of the Township's ground waters.

UNIQUE GEOLOGIC FEATURE
A scenic geologic feature which has been identified in the Pennsylvania Geologic Survey publication entitled Outstanding Scenic Geologic Features of Pennsylvania. An area designated as a unique geologic feature on the Official Map shall not be altered, regraded or built upon unless the landowner follows all provisions in this chapter and Article IV of the MPC. The unique geologic features include the following:
A. 
CHIMNEY ROCKLocated one mile north of Hallam Borough, spectacular twin pinnacles of Hellam conglomerate rise 30 feet above the ridge line in a dense stand of oak trees.
B. 
WILDCAT RUN CLIFFS AND GORGEAbout two miles west of Accomac, the wild and scenic gorge of Wildcat Run exposes vertical cliffs of the Chickies Formation.
C. 
ROUNDTOP OVERLOOKOn crest of the Hellam Point ridge, a rock overlook composed of Chickies quartzite. Minor amount of Catoctin slate present.
D. 
HELLAM POINTA ridge line composed of Chickies quartzite which extents out into the Susquehanna River forming a point.
E. 
SCHULL'S ROCKA cliff of Chickies quartzite just east of the mouth of the Codorus Creek.

The Board of Supervisors of the Township of Hellam hereby adopts that Map prepared by C.S. Davidson, Inc., dated October 9, 2003, attached hereto and incorporated herein as Exhibit A,[1] indicating existing and proposed streets and highways, existing and proposed open space and recreation areas, including but not limited to woodland reservations, and unique geologic features within the Township as the Official Map of the Township of Hellam.

The proper officials of the Township are authorized to take all steps necessary to record the Official Map in the Office of the Recorder of Deeds in and for York County, Pennsylvania, as required by Section 402(c) of the MPC.[1] The proper officials of the Township are further authorized to transfer certified copies of the Official Map to the entities required to be provided with copies of an official map by the MPC.

Owners of land identified as reserved on the Official Map shall have all rights set forth in Article IV of the MPC. Landowners may apply for all permits authorized in MPC Article IV and shall use the procedures set forth in MPC Article IV.[1]
