A. 
It shall be unlawful for any person to use or trespass on any Town beach between the hours of 10:00 p.m. and 5:00 a.m. or to bathe in said bay inside of the Town without a bathing suit at any time. For the purposes of this subsection, a bathing suit does not include what is commonly referred to as a “thong," "g-string," "swiss string" or "micro bikini.” The wearing of these types of bathing suits by males or females is prohibited on the Town of North Beach beach within sight of the Town.

B. 
It is the intent of this subsection to prevent extensive picnicking on the beach. It shall be unlawful for any person to bring onto the public beach (boardwalk, waterfront areas, municipal parking lots, or public park) of the Town of North Beach any cooler, beverage cooler, personal cooler, soft-sided cooler or picnic cooler bag larger than 16 inches by 16 inches by eight inches or nine quarts in volume. (This includes large grocery bags or boxes used to carry groceries and bushels of crabs.) This chapter is not intended to prevent individuals from bringing food or drink onto the beach (or public areas as identified above) for limited personal use as stated above and is also not intended to prevent fishermen from using coolers or containers to carry bait on legal fishing areas within the Town limits.

C. 
Use of the Town beach will be free of charge to any resident of the Town and to any guest of a resident of the Town. Any nonresident not visiting a Town resident wishing to use the Town beach may be charged a reasonable fee which will be set from time to time by the Mayor and Town Council. The Mayor and Town Council will also determine and set by resolution the method by which residents and nonresidents of the Town will be identified for the purpose of collecting said fee.

Violations of this chapter shall be a municipal infraction, punishable as provided in Chapter 1, General Provisions, Article III, Penalties.
