The codes, as follow, shall be the official codes of the Town of North
Beach, Calvert County, Maryland, in all matters covered by the codes:
A. The BOCA International Property Maintenance Code, 1998
Edition, with following amendments:
(1) Section 101.1 (page 1, second line). Insert: The Town
of North Beach.
(2) Section 103.6 (page 2, third line). Insert: Fines, fees
and penalties shall be adopted by Town Council Resolution, from time to time.
(3) Section 303.15 (page 10, first line). Delete: Part of
first sentence as reads: "During the period from [date] to [date],". The word
"every" shall be capitalized as "Every" for the first word in sentence.
(4) Section 602.3 (page 17, fifth line).

As reads: "602.3 Heat Supply: Every owner and operator of any building
who rents, leases or lets one or more dwelling unit, rooming unit, dormitory
or guestroom on terms, either express or implied, to furnish heat to the occupants
thereof shall supply sufficient heat during the period from October
1 to April 30 to maintain a temperature of not less than 65° F. (18°
C.) in all habitable rooms, bathrooms and toilet rooms."

B. The BOCA National Building Code, Fourteenth Edition,
1999, with the following amendments:
(1) Section 101.1. Insert: the Town of North Beach, Maryland.
(2) Section 112.3.1. Insert: Fines, fees and penalties shall
be adopted by Town Council Resolution, from time to time.
(3) Section 116.4. Insert: Fines, fees and penalties shall
be adopted by Town Council Resolution, from time to time.
(4) Section 117.2. Insert: Fines, fees and penalties shall
be adopted by Town Council Resolution, from time to time.
(5) Section 3408.2. Insert: October 12, 1995.
C. The BOCA International Plumbing Code, 1997 Edition, with
the following amendments:
(1) Section 101.1 (page 1, second line). Insert: The Town
of North Beach, Maryland.
(2) Section 106.5.2 (page 4, third line). Insert: Fines,
fees and penalties shall be adopted by Town Council Resolution, from time
to time.
(3) Section 106.5.3 (page 4, fifth and eighth lines). Insert:
Fines, fees and penalties shall be adopted by Town Council Resolution, from
time to time.
(4) Section 108.4 (page 6, eighth and ninth lines). Insert:
Fines, fees and penalties shall be adopted by Town Council Resolution, from
time to time.
(5) Section 108.5 (page 6, thirteenth and fourteenth lines).
Insert: Fines, fees and penalties shall be adopted by Town Council Resolution,
from time to time.
(6) Section 305.6.1 (page 18, second and fifth lines). Insert:
30 inches.
(7) Section 904.1 (page 63, second line). Insert: 12 inches.
D. The BOCA National Fire Prevention Code, Eleventh Edition,
1999, with the following amendments:
(1) Section F-101.1. Insert: the Town of North Beach.
The Mayor, within his or her sole discretion, shall appoint the Code
Enforcement Officer. The Code Enforcement Officer may also be referred to
as the Code Official or Building Inspector.
Permits shall be obtained for any work performed or required by the
BOCA Codes, except painting. No work shall begin until a permit has been obtained.
All permits shall be valid in accordance with appropriate BOCA Code.

A. Once any structure within the town is left vacant, the
exterior structure and premises must be maintained to the minimum standards
of this chapter and the applicable BOCA Codes. Any boarding of windows and
doors to secure the structure shall be done in a workmanlike manner, and the
materials used shall conform to the overall exterior appearance of the structure
and be in conformance with the minimum requirements of the applicable town
and BOCA Codes. All exterior surfaces and materials, including wood composition,
cinder block or metal, shall be maintained in a weatherproof condition and
surface coated to match the structure's exterior facade.
B. Any abandoned dwelling units, except for historic sites,
as defined by the North Beach Historic Preservation Commission, which exterior
openings have been closed and sealed for greater than 12 months must be made
habitable or usable according to habitability and BOCA Codes within six months
of notice by the town, a copy of which shall be transmitted to the North Beach
Historic Preservation Commission for its review, or the structure will be
razed as a dangerous structure pursuant to the town and BOCA Codes. A party
may appeal the decision to raze the structure as is presently provided in
the code, but the Board of Appeals shall not have jurisdiction to grant a
variance or waive this section except upon a finding that litigation is pending
in the courts and is actually being pursued, which litigation would finally
determine legal ownership of the property, or upon a finding that litigation
is pending regarding disposition of an insurance claim arising from the subject
property.

Failure to comply with any official written directive, order or requirement pursuant to the appropriate BOCA Code shall be considered to be a misdemeanor, punishable as provided in Chapter
1, General Provisions, Article
III, Penalties, unless the specific BOCA Code stipulates otherwise.
