Anything herein contained to the contrary notwithstanding, the Township
Committee may, upon application duly made as herein provided:
A. Grant by resolution a thirty-day temporary permit to
maintain a trailer to an applicant who is a landowner within the Township
of Franklin and who will use such trailer for his personal use and that of
his family only, whose home within the Township of Franklin has suffered damage
by fire, flood, act of God or other casualty. In order to qualify, such applicant
must express his intention to repair and/or rebuild and actually repair and/or
rebuild within one year from the date of such loss or casualty. The application
fee shall be $25, payable to the Township Clerk, prior to the issuance of
the permit. Such permit may be reissued at the option and discretion of the
Township Committee for an additional period of 30 days, up to a total of 180
days, upon a renewal application submitted by the applicant. An additional
fee of $25 shall be paid by the applicant to the Township Clerk as above set
forth for each such thirty-day renewal. Should applicant repair and/or rebuild
his home on the site where the loss or casualty occurred or upon other lands
within the Township of Franklin which applicant owns or which he may acquire
following such loss or casualty within the one-year period aforesaid, then
and in that event, he shall be entitled to receive a rebate of $20 from each
$25 thirty-day fee paid by such applicant. Should the applicant fail to repair
and/or rebuild as aforesaid, all application fees shall remain the property
of the Township of Franklin and applicant will not be entitled to a rebate
or rebates.
B. Grant by resolution a temporary permit not exceeding
one year to maintain a trailer on lands within Franklin Township to a resident
of Franklin Township who is and has been the owner of a trailer lawfully situated
on property located within Franklin Township outside of a licensed mobile
home park who will use such trailer for his personal use and that of his family
only. Said temporary permit may only be granted by the Township Committee
when the strict application of this chapter would result in peculiar and exceptional
practical difficulties to or exceptional and undue hardship upon the owner
of such trailer. Said temporary permit may be reissued upon motion at the
option and discretion of the Township Committee. All applications for said
permits shall be accompanied by a nonrefundable fee of $50, payable to the
Township Clerk. The Township Clerk shall fix a reasonable time for the hearing
of the application, giving due notice thereof to the applicant. Said applicant
shall at least 10 days prior to the time appointed for said hearing give personal
notice to all owners of property situate within or without the municipality,
as shown by the most recent tax lists of Franklin Township, whose property
or properties as shown by said list are located within 200 feet of the property
to be affected by said application. Such notice shall be given either by handing
a copy thereof to the property owners or by leaving a copy thereof at their
usual place of abode, if said owners are the occupants of the property affected
by such application or are residents of Franklin Township in which said property
is located. Whenever said owners are nonresidents of Franklin Township, such
notice may be given by sending written notice thereof by registered mail to
the last known address of the property owner or owners, as shown by the most
recent tax lists of Franklin Township. Where the owner is a partnership, service
upon any partner as above provided shall be sufficient, and where the owners
are corporations, service upon any officer, as above set forth, shall be sufficient.
The applicant shall by affidavit present satisfactory proof to the Township
Committee at the time of the hearing that said notices have been duly served
as aforesaid. Upon the hearing any party may appear in person or by agent
or by attorney.
All other provisions of this chapter with respect to operation and maintenance
of a trailer herein contained shall apply on a temporary license or its renewal.
