§ 87-1 Adoption of state standards; applicability.

There is hereby adopted by reference in the Town the Virginia Uniform Statewide Building Code, hereinafter referred to as the "Building Code." The provisions of the Building Code are adopted and shall control all matters concerning the design, construction, alteration, addition, enlargement, repair, removal, demolition, conversion, use, location, occupancy and maintenance of all buildings, and all other functions which pertain to the installation of systems vital to all buildings and structures in their service equipment as defined by the Building Code, and shall apply to existing and proposed buildings or structures in the Town.

§ 87-2 Building permit required prior to supplying electricity.

It shall be unlawful for any electrical supply company to furnish electrical power to any building or structure covered by this chapter until it has verified that a building permit has been issued for the structure in question, or that none was required, and that all necessary inspections have been completed, or that none were required.

§ 87-3 Unsafe buildings.

A. Unsafe buildings pose a threat to life and property in the Town of Stanley. Buildings and structures may become unsafe by reason of damage by fire, the elements, age or general deterioration. Vacant buildings not properly secured at doorways and windows also serve as an attractive nuisance for young children who may be injured therein, as well as a point of congregation by vagrants and transients. A dilapidated building may also serve as a place of rodent infestation, thereby creating a health menace to the community. Debris, rubble or parts of buildings left on the ground and not removed constitute a dangerous, unhealthy and unsightly condition. It is the purpose of this section to provide for the safety, health, protection and general welfare of persons and property in the Town of Stanley by requiring such unsafe buildings to be repaired or demolished and removed.

B. Definitions. As used in this section, the following terms shall have the meanings indicated:

BUILDING

Any building, structure or portion thereof used for residential, business, industrial, recreational or other purpose.

BUILDING INSPECTOR

The Building Inspector of the Town of Stanley or such other person appointed by the Town Council to enforce the provisions of this section.

PORTION OF BUILDING OR STRUCTURE

Any debris, rubble or parts of buildings which remain on the ground or on the premises after demolition, reconstruction, fire or other casualty.

UNSAFE BUILDING OR STRUCTURE

Any building or structure or portion thereof which:

(1) Because of its structural condition, is or may become dangerous or unsafe to the public.

(2) Is open at the doorways or windows or walls, making it accessible to and an object of attraction to minor under 18 years of age as well as to vagrants and other trespassers.

(3) Is or may become a place of rodent infestation.

(4) Consists of debris, rubble or parts of buildings left on the ground after demolition, reconstruction, fire or other casualty.

(5) Presents any other danger to the health, safety, morals and general welfare of the public.

C. Maintenance of buildings and structures. It shall be unlawful for any owner, tenant or occupant of any building or structure or portion of any building or structure in the Town of Stanley to maintain such building or structure or portion of any building or structure in any condition or manner which shall be unsafe as defined in Subsection B of this section.

§ 87-4 Penalties for offenses.

A. It shall be unlawful for any person to violate or fail to comply with the provisions of the Building Code or this chapter. Any person who violates or fails to comply with the provisions of the Building Code or this chapter shall, upon conviction thereof, be punishable under the provisions of § 1-16 of this Code.

B. It shall be deemed a separate offense for each and every day during which a violation of the provisions of this chapter is committed, continued or permitted by any violator, and said offense shall be punishable as hereinabove provided.
