The owner of any building in which there exists an elevator shall have the same inspected semiannually by an approved agency. The owner of any building in which there exists an elevator shall choose which agency shall inspect each elevator, provided that the agency is approved by the municipality's Building Code Official or his or her equivalent.
If, after the inspection of an elevator, an approved agency authorizes the usage of an elevator by certifying that all N.J.A.C., BOCA and ANSI dictates are satisfied, that agency shall issue to the municipality's Building Code Official a certificate authorizing such use. It shall be the duty of the Building Code Official to affix said certificate in a prominent, conspicuous area in the subject elevator.
If, after the inspection of an elevator, an approved agency finds that an elevator is unsafe for public usage and in need of repair, he shall immediately notify both the owner and the Building Code Official. The Building Code Official shall place a warning in a prominent, conspicuous place, on the door of the malfunctioning elevator or as close thereto as practicable, which warning shall state that the elevator shall not be used by anyone unless and until said elevator is repaired and a certificate authorizing such use is displayed in the manner set forth in § 97-2. The Building Code Official shall seal the elevator until all repairs are completed and shall notify the owner of such action.
If at any time during the semiannual inspections provided for in § 97-1 an owner is apprised or informed that an elevator is malfunctioning, he shall immediately notify the Building Code Official, who shall post a warning in the manner set forth in § 97-3 and shall immediately contact an approved elevator agency to repair the elevator. Said elevator shall be sealed by the Building Inspector until all repairs are completed and shall notify the owner of such action.

Any owner who shall operate or shall allow the public to use any malfunctioning elevator as so stated in this chapter shall, upon conviction, be punishable by a fine not exceeding $2,000, imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days, or a combination thereof.
