§ 2-446 Award to lowest responsive and responsible bidder.
[ Ord. No. 10376 , 12-15-2016 ] The award shall be made to the lowest responsive and responsible bidder in accordance with the standards set forth in § 2-426 by the Director of Procurement after consultation with the using agency.
§ 2-447 Justification of award to other than low bidder.
[ Ord. No. 10376 , 12-15-2016 ] When the award is not given to the lowest bidder, a full and complete statement of the reasons for placing the order elsewhere shall be prepared by the Director of Procurement and filed with the other documentation relating to the transaction.
§ 2-448 Award to local bidder; tie bids.
[ Ord. No. 10376 , 12-15-2016 ] If all bids received are for the same total amount or unit price, quality and service being equal, the contract shall be awarded to a local bidder. If there shall be no local bidder or more than one local bidder with a low equal bid, the Director of Procurement shall award the contract to one of the tie bidders by drawing lots in public.

Ch 2 Art VI Div 6 Policy and Procedure for Procurement of Architectural, Engineering, Land Surveying and Other Professional Services
§ 2-480 Adoption of policy and procedure.
[ Ord. No. 10376 , 12-15-2016 ] The City does adopt and establish a policy and procedure for the selection and procurement of professional services, including architectural, engineering and land surveying, in accordance with the following provisions.
§ 2-481 Implementation of policy.
[ Ord. No. 10376 , 12-15-2016 ] The Director of Procurement is hereby directed to implement the provisions of the policy and have the authority and responsibility to fully manage and direct all using agencies and procurement staff in the procurement process set forth herein.
§ 2-482 Policy and procedures.
[ Ord. No. 10376 , 12-15-2016 ] The following shall be the policy and procedures for selecting architectural, engineering, land surveying services and other professional services (hereinafter referred to as "professional services") for the City of Kirkwood.
§ 2-483 Definitions.
[ Ord. No. 10376 , 12-15-2016 ] As used in this article, the following terms shall have the meanings indicated:
2-483{1} ARCHITECTURAL SERVICES
ARCHITECTURAL SERVICES Those services within the scope of the practice of architecture as defined by the laws of the State of Missouri.
2-483{2} CITY
CITY The City of Kirkwood.
2-483{3} CITY COUNCIL
CITY COUNCIL The Mayor and Council of the City of Kirkwood.
2-483{4} ENGINEERING SERVICES
ENGINEERING SERVICES Those services within the scope of the practice of engineering as defined by the laws of the State of Missouri.
2-483{5} FIRM
FIRM Any individual, firm, partnership, corporation, association, or other legal entity permitted by law to practice the profession of architecture, engineering, or land surveying, or other professional services and to provide said services.
2-483{6} LAND SURVEYING SERVICES
LAND SURVEYING SERVICES Those services within the scope of the practice of land surveying services as defined by the laws of the State of Missouri.
2-483{7} OTHER PROFESSIONAL SERVICES
OTHER PROFESSIONAL SERVICES Those services of a vocation requiring specialized knowledge and intensive academic or technical training in such fields as land appraisal, urban planning, finance, real estate, and others as determined by the Director of Procurement.
