§ 1.08.071 Monthly deposits by city for use of perpetual care fund.

The city shall deposit monthly with the trustee, for the use and benefit of the city’s perpetual care fund of the city’s cemeteries, mausoleum and memorial park, the sum of one hundred dollars ($100.00) per space sold, and the sum of one hundred dollars ($100.00) for each crypt in the mausoleum building sold as provided by V.T.C.A., Health and Safety Code sec. 712.021 . Such perpetual care fund shall be charged to each purchaser of a space or mausoleum crypt in addition to the sale price specified in section 1.08.074 . ( 1991 Code, sec. 8-46 )

§ 1.08.072 Payment of net income of perpetual care fund to city.

The trustee is directed to pay the city the entire income, less expenses, from the perpetual care fund at such time as may be agreeable to the city and the trustee. ( 1991 Code, sec. 8-47 )

§ 1.08.073 Deposit of income and proceeds from sale of cemetery lots, etc.; use of deposits.

The manager and the finance director of the city are authorized to deposit such income in the general fund of the city, as well as the proceeds from the sale of all lots and crypts of the city’s cemeteries, to be used solely for the care, operation and maintenance of the city’s cemeteries and mausoleum building. § 1.08.074 Sale price of grave spaces and lots.

(a) Hereafter, all grave spaces for interment, and regardless of location whether in Memorial Park, West Hill Cemetery, or West Hill Annex, shall be sold for amounts listed below: (1) Premium spaces in Annex D sections three and four, full space (10' x 40"): $1,500.00. (2) Full spaces (10' x 40"): $1,000.00. (3) Half spaces (5' x 40"): $500.00. (b) All crypts in the mausoleum building will be sold at prices ranging from five hundred fifty dollars ($550.00) to eight hundred dollars ($800.00) per crypt as currently carried on the city’s books. § 1.08.075 Fees for cemetery services.

(a) The following fees are established for services rendered in the cemetery as follows: (1) Preparation of grave. Ch 1 Art 08 Div 4 West Hill Cemetery Advisory Board

§ 1.08.101 Created; composition.

There is hereby created and established an advisory board known as the West Hill Cemetery Advisory Board; such board to be composed of five (5) citizens of the city who shall reside within the corporate limits of the city during their term of appointment. ( 1991 Code, sec. 8-71 )

§ 1.08.102 Appointment; terms.

Membership to the cemetery advisory board shall be by appointment by members of the city council for a term of two (2) years each. A member of the cemetery advisory board can serve a maximum of two (2) successive terms. After at least a one-year absence from such board, the person will be eligible for reappointment. All members shall serve at the pleasure of the city council. ( 1991 Code, sec. 8-72 )

§ 1.08.103 Compensation of members.

Members of the West Hill Cemetery Advisory Board shall serve without pay, but may receive reimbursement for the actual expenses incurred after prior approval of the city when such expenses result from the performance of official duties. ( 1991 Code, sec. 8-73 )

§ 1.08.104 Officers; meetings.

The cemetery advisory board shall elect from its membership a chairman who shall serve for a term of one (1) year and who shall be eligible for reelection. The chairman shall preside over the board and shall have the right to vote. There shall also be elected from the board a recording secretary who shall serve a term of one (1) year with right of reelection. Such recording secretary shall record the minutes of the board meetings for review by the city council. The board shall meet at such times as it may determine or upon call of the chairman. § 1.08.105 Duties.

The West Hill Cemetery Advisory Board shall act in an advisory capacity to the city council. It shall review current fees and charges for cemetery services and advise the city council as to any recommended changes. It shall review cemetery and mausoleum rules and regulations and recommend changes in same to the city council for approval. It shall advise the city council on short- and long-range cemetery planning for grounds and building upkeep as well as expansion of such cemetery. It shall provide such other cemetery advisory functions as may be directed by the city council. ( 1991 Code, sec. 8-75 )

§ 1.09.001 Organization.

(a) There exists the office of emergency management director of the city, which shall be held by the mayor in accordance with state law. An emergency management coordinator may be appointed by and serve at the pleasure of the city manager. (b) An assistant to the emergency management coordinator may be appointed by and serve at the pleasure of the emergency management coordinator. (c) The director shall be responsible for a program of comprehensive emergency management within the city and for carrying out the duties and responsibilities set forth in this article. § 1.09.002 Emergency management director’s powers and duties.

The duties and responsibilities of the emergency management director shall include the following: (1) Conduct an ongoing survey of actual or potential hazards which threaten life and property within the city and an ongoing program of identifying and requiring or recommending the implementation of measures which would tend to prevent the occurrence or reduce the impact of such hazards if a disaster did occur. (2) Supervision of the development and approval of an emergency management plan of the city, and shall recommend for adoption by the city council all mutual aid arrangements deemed necessary for the implementation of such plan. § 1.09.003 Emergency management plan.

A comprehensive emergency management plan shall be developed and maintained in a current state. The plan shall set forth the form of the organization; establish and designate divisions and functions; assign responsibilities, tasks, duties, and powers; and designate officers and employees to carry out the provisions of this article. As provided by state law, the plan shall follow the standards and criteria established by the state division of emergency management. § 1.09.004 Interjurisdictional program.

The mayor is hereby authorized to join with the county judge of the county and the mayors of the other cities in said county in the formation of an interjurisdictional emergency management program for the county and shall have the authority to cooperate in the preparation of an interjurisdictional emergency management plan and in the appointment of a joint emergency management coordinator, as well as all powers necessary to participate in a countywide program of emergency management insofar as said program may affect the city. § 1.09.005 Override.

At all times when the orders, rules, and regulations made and promulgated pursuant to this article shall be in effect, they shall supersede and override all existing ordinances, orders, rules, and regulations insofar as the latter may be inconsistent therewith. ( 1991 Code, sec. 10-34 )
