There shall be in and for the Town of Dover
a Board of Health, in accordance with "An Act to establish in this
State Boards of Health and a Bureau of Vital Statistics and to define
their respective powers and duties," approved March 31, 1887, and
the acts supplementary thereto and amendatory thereof.
[Amended 12-26-1972; 5-28-1996 by Ord. No. 19-1996; 2-10-2004 by Ord. No. 4-2004; 2-25-2020 by Ord. No. 09-2020]
A. Said Board of Health shall consist of five members and two alternate
members to be appointed by the Mayor and Board of Aldermen of the
Town of Dover pursuant to N.J.S.A. 26:3-3. At the time of appointment,
the alternate members shall be designated as "Alternate No. 1" and
"Alternate No. 2."
B. All members of the Board of Health shall hold said office for the
term of three years, except that of the five members first appointed
by the governing body two shall be appointed for a term of one year,
two shall be appointed for a term of two years and one shall be appointed
for a term of three years. The terms shall be so arranged to insure
that the terms of not more than two members shall expire in any one
year. Members appointed to fill a vacancy caused otherwise by the
expiration of the term of office shall fill the vacancy for the unexpired
term only.
C. The alternate members of the Board of Health shall hold said office
for a period of two years, except that the terms of the alternate
members first appointed shall be two years for Alternate No. 1 and
for one year for Alternate No. 2, so that the term of not more than
one alternate member shall expire in any one year. A vacancy occurring
otherwise than by expiration of term shall be filled by the appointing
authority for the unexpired terms.
D. The alternate members of the Board of Health may participate in discussions
of the proceedings of the Board of Health but may not vote except
in the absence or disqualification of a regular member. A vote shall
not be delayed in order that a regular member may vote instead of

which alternate member is to vote, Alternate No. 1 shall vote first.
Said Board of Health shall appoint a Registrar
of Vital Statistics, Clerk and Sanitary Inspector, and it may also
appoint such officers or assistants as said Board of Health may deem

Board. The police officers of the Town of Dover shall be special sanitary
inspectors, and they shall promptly report to the Board of Health
every violation of the health ordinances of the Town of Dover which
may come within their observation or knowledge.
