Any member of the Police Department of the Borough of Totowa shall be subject to reprimand, suspension from duty without pay, reduction in rank or dismissal from the Department for any of the following causes:
A. 
That the member of the Department is incompetent or inefficient in the performance of his duties.
B. 
That the member of the Department has been careless or negligent in the performance of duty.
C. 
That the member of the Department has been offensive in his treatment of public charges, fellow members of the Department or other persons.
D. 
That the member of the Department has some permanent or chronic physical or mental ailment or defect of such a nature and severity that it incapacitates him for the proper performance of his duties.
E. 
That the member of the Department has violated any lawful official regulation or order or failed to obey any lawful or reasonable directions given him by his superiors when such violation or failure to obey amounts to insubordination or serious breach of discipline.
F. 
That the member of the Department has taken a fee, gift or other valuable thing in the course of his work or in connection with it when such a fee, gift or other valuable thing is given him by any person or organization for receiving a favor or better treatment than that accorded other persons.
G. 
That the member of the Department has been convicted of a criminal offense.
H. 
That the member of the Department through willful conduct has caused damage to public property or waste of public supplies.
I. 
That the member of the Department is habitually tardy, habitually absent without notice, drunk, dishonest or loses his driver's license when necessary for the performance of his duty.
J. 
Disrespect to a superior officer.
K. 
Unnecessary violence to a prisoner.
L. 
Neglect in paying his just debts contracted while in the Department.
M. 
Gross ignorance of the laws and regulations governing the Department.
N. 
For making known any proposed action or movement of the Department or contents of any order, other than to persons immediately concerned in their execution.
O. 
Conduct unbecoming an officer and a gentleman.
P. 
Conduct subversive to good order and discipline of the Department.
Q. 
Publicly commenting on the official action of a superior officer.
R. 
Neglecting to turn over to the Treasurer, within 48 hours of receipt, any money received by him on behalf of the Borough of Totowa.
S. 
Soliciting anyone to intercede with the Chief of Police, Deputy Chief, the Mayor and Council or any superior officer in relation to promotions, changing any beats, disposition of pending charges or any findings of a trial before the Mayor and Council or for refusing to do duty or evading duty of any kind whenever necessity requires, whether in uniform or not.

T. 
Violation of any law, ordinance or regulation governing the Department or its members.
A. 
The procedure for disciplining a member of the Department shall be in accordance with the provisions of Chapter 72, Personnel Policies, except insofar as the same may conflict with the statutes of the State of New Jersey and, in case of such a conflict, the provisions of the state statute shall govern.
B. 
Upon being dismissed or suspended, a member of the Department shall promptly surrender all property of the Department which may be in his possession. All such property shall be retained by the Chief of Police, and, if the member is suspended, it shall be returned to him upon the termination of his period of suspension or upon restoration to duty. He shall not, under any circumstances, at any time, wear his police uniform.[1]
