[HISTORY: Adopted by the Town Board of the Town of Fenton 6-4-1997. Amendments noted where applicable.]
It is the purpose of this chapter to provide a comprehensive schedule of fees that may be properly charged and for charging disbursements on behalf of the Town of Fenton pursuant to state law or the various chapters of the Town of Fenton Municipal Code.
A. 
Whenever by any provision of the New York State Fire Prevention and Building Code or the Town of Fenton Municipal Code the issuance of a permit or other action by any agency, officer or employee of the Town is required, the fee thereafter shall be determined by reference to the following schedule:

(1) 
For a building permit (including an occupancy permit on completion) authorizing the construction of a building, addition, structural alteration or structural improvement:
(a) 
In the case of a one- or two-family dwelling, a multiple dwelling or associated improvements: $0.08 per square foot of the building, addition or improvement, or a minimum of $50; provided, however, that no fee shall be required to obtain a building permit for a handicap ramp providing access to a residential structure.

(b) 
In connection with other nonresidential improvements: $0.08 per square foot or a minimum of $50 and a maximum of $500.
(c) 
In the case of dwellings [factory manufactured homes (modular homes)] located within mobile home parks: $50. Site visits by the Building Inspector to determine compliance with applicable codes in excess of two shall incur an additional fee of $50 for each visit. In the case of additions or improvements of dwellings located within mobile home parks: $0.08 per square foot (of the addition or improvement) or a minimum of $50.

(2) 
For moving a building or structure or demolition:
(a) 
For moving any building or structure to a new location in the Town of Fenton: $50.

(b) 
For demolition or wrecking of any building or structure: no fee.
(c) 
A building permit must be obtained from the Town Building Inspector before conducting any of the operations set forth in this subsection.
(3) 
For the erection of a sign or billboard equal to or exceeding 40 square feet in area: $50; other signs or billboards: $25 each.
(4) 
For the renewal of a building permit: same as original fee.
B. 
Other charges. The following fees shall be charged pursuant to the referenced Code section.

In the event that any work is unlawfully commenced prior to the issuance of a permit, the permit fee shall be twice the amount of the fee stated above or a minimum of $100.

In addition to payment of applicable fees, each applicant for a permit or license under any state law or regulation or Town of Fenton local law shall be required to reimburse the Town of Fenton for expenses incurred by the Town for retaining engineering, planning and architectural consultants to review an applicant's plans on behalf of the Town and for all disbursements necessarily incurred in the processing of the application, including the costs of legal advertising.
