The purpose of this chapter is to prescribe, in accordance with prevailing community standards, regulations for the conduct of minors on or upon public places, for the protection of such minors and others, during the hours set forth herein, for the enforcement of parental control and responsibility for their children, to reduce juvenile activity, for the furtherance of family responsibility and for the promotion of the safety and health of the citizens of South Strabane.
The following terms shall have the meanings indicated, unless a different meaning clearly appears from the context:
MINOR
A person under the age of 18 years of age.
PARENT
Any natural or adoptive parent of a minor, as herein defined, or a guardian or any adult person responsible for the custody and care of a minor. "Parents" shall mean one or both parents.
PUBLIC PLACE
Any public street, alley, sidewalk, park, playground, parking lot, public building or vacant lot within South Strabane Township.
REMAIN
To stay behind, tarry or to stay unnecessarily in or upon a public place, including the congregating of groups or otherwise interacting minors, in which any minor involved is not using the public place for emergencies or ordinary purposes, such as educational, religious or business, and such as the mere passage of going home or to/from work.
A. 
It shall be unlawful for any minor to remain in a public place within the Township of South Strabane between the hours of 11:00 p.m. to 6:00 a.m., Sunday through Thursday, and between the hours of 12:00 midnight to 6:00 a.m., Friday and Saturday.
B. 
Exceptions to the above:
(1) 
A minor accompanied by a parent, guardian, or other person having legal care and custody of the minor.
(2) 
A minor who is lawfully employed and who is lawfully performing the duties of their employment.
(3) 
A minor on an emergency errand.
It shall be unlawful for a parent, having the legal custody and care of a minor, to knowingly allow or permit a minor to violate § 102-3.
A. 
Any minor found in violation of § 102-3 shall be taken into custody and be delivered to the minor's parent, legal guardian, or adult responsible for the custody and care of the minor. In addition, the minor may be cited and, upon conviction thereof, may be sentenced to pay a fine of $25 for the first offense, $50 for the second offense and $100 for each subsequent offense, along with the cost of prosecution.
B. 
Any parent, legal guardian, or adult responsible for the custody and care of a minor found to be in violation of § 102-4 may be cited and, upon conviction thereof, may be sentenced to pay a fine of $25 for the first offense, $50 for the second offense and $100 for each subsequent offense, along with the cost of prosecution.
