No person, firm, partnership or corporation
owning or having a present interest in or occupying any real estate
within College Township shall permit any grass or weeds or vegetation
whatsoever, not edible or planted for some useful or ornamental purpose,
to grow or remain on such premises, including any portion of the premises
occupied by a street or alley, so as to exceed a height of 12 inches
or to throw off any unpleasant or noxious odor or to conceal any filthy
deposit or to create or to produce pollen. All such vegetation is
hereby declared to be a nuisance and detrimental to the health, safety,
cleanliness and comfort of the inhabitants of College Township.
The owner of any such premises, whether occupied by the owner or not, and the occupant thereof in case of premises occupied by other than the owner thereof, shall remove, trim or cut all such vegetation growing or remaining upon such premises in violation of the provisions of §
196-1. Both the owner and the occupant, in the case of premises occupied by other than the owner, shall be responsible for the compliance with this chapter.
The terms of this chapter do not apply to:
A. Properties greater than 10 acres in the Agricultural,
Forest and Rural Residential Zoning Districts.

B. Vegetation growing more than 50 feet from a premises
on which there is a dwelling or other occupied structure or more than
100 feet from a dwelling or other occupied structure, whichever is
less.
D. Vegetation growing intermingled with cultivated crops
until such time as said crop is harvested or should have been harvested.
The terms of this chapter will effectively be
carried out and enforced by the College Township Ordinance Enforcement
Officer. Either or both the owner and occupant are responsible for
compliance with this chapter.
The penalty for not cutting or removing the
vegetation shall be a fine of not less than $10 nor more than $25,
plus costs of the action, or imprisonment in the county jail for not
more than 10 days. Each day's violation shall constitute a separate
offense, and notice to the offender shall not be necessary to constitute
a separate offense, nor shall notice to the offender be necessary
to constitute an offense.

In addition to the penalties as herein imposed, the Township
and/or its designated agent shall have the right to remove, trim or
cut grass, weeds or other vegetation that is growing or remaining
in violation of this chapter, and the cost, together with any penalties
as herein imposed, may be collected by the Township as a municipal
lien or in any other manner provided by law.
