From and after the effective date of this article, it shall be unlawful for the owner or owners of any dog or dogs, whether licensed or unlicensed, to permit or allow such dog or dogs to run at large or unattended in the Borough of Eagles Mere.
Any police officer, constable or Code Enforcement Officer of the borough is hereby authorized and empowered to apprehend and detain any licensed dog or to require the owner of the same to secure and confine such dog.

Upon the apprehension of any dog, duly licensed, the owner of said dog shall be ascertained through the license number which shall be prima facie evidence of ownership, or by any other method. Such owner shall be notified, and if said dog shall have been detained, said owner shall pay the Borough of Eagles Mere for costs of detention.
Any dog running at large within the Borough of Eagles Mere not duly licensed or bearing a current license tag shall be deemed a stray dog and may be detained at the owners expense as set forth in § 45-3, or disposed of by any such police officer, constable, Code Enforcement Officer or or someone authorized by him.

Any person, firm or corporation who or which violates any provision of this article shall, upon conviction thereof, shall be punishable by a fine not exceeding $600, plus costs of prosecution for each offense, and in default of payment of such fine and costs to imprisonment in the county jail for a term not exceeding 30 days. Each day that a violation of this article continues shall constitute a separate offense.
