This chapter shall be known and may be cited as the "Village of Pleasantville Taxicab Law."
The purpose of this chapter is to provide for adequate and proper control of taxicab service within the Village of Pleasantville, pursuant to the rules and regulations of the Westchester County Taxi and Limousine Commission (WCTLC).
As used in this chapter, unless the subject matter or context otherwise requires, the following words shall have the meanings indicated:
OPERATE
The use of one or more taxicabs for hire upon the streets of the Village of Pleasantville or engaged in the business of using a taxicab which is at any time used to carry passengers for hire.
STREET
Includes any street, alley, avenue, bridge, lane or public place in the Village of Pleasantville.
TAXICAB
Includes any motor vehicle engaged in the business of or at any time used to carry persons for hire, except vehicles subject to the provisions of the Transportation Corporations Law.
TAXICAB STAND
Includes any place which is exclusively reserved by the Village Board of Trustees for the use of taxicabs.
A taxicab shall only be regularly operated from an approved taxicab stand, and, further, no person may regularly keep for hire within the limits of the Village of Pleasantville any taxicab without having obtained a driver's permit issued by the Westchester County Taxi and Limousine Commission (WCTLC) and having the same in force and in effect under the provisions of this chapter.
A. 
The Village Board of Trustees, by local law which may be amended from time to time, shall establish the location of taxicab stands and the number of taxicabs at each taxicab stand within the Village of Pleasantville.
B. 
No person shall operate a designated taxicab stand within the Village of Pleasantville unless such location is approved by the Village Board of Trustees.
C. 
All persons or organizations desiring to operate a designated taxicab stand within the Village of Pleasantville shall submit an application for a taxicab stand permit to the Village Clerk for review by the Village Board of Trustees. Each person or organization shall be allowed to apply for up to two taxicab spaces. When taxicab spaces are allocated, a waiting list shall be maintained by the Village Clerk.
D. 
Fees for the use of a taxicab stand shall be set forth by resolution by the Village Board of Trustees in the Master Fee Schedule, which may be amended from time to time.
E. 
At the discretion of the Village Board of Trustees, a taxicab stand permit may be suspended or not renewed for just cause by a resolution by the Village Board of Trustees. The holder of the taxicab stand permit shall be given written notice of the Village Board of Trustees' intention not to renew or suspend the taxicab stand permit and shall be given an opportunity to be heard by the Village Board of Trustees before a final determination is made.
F. 
Taxicab stand permits must be displayed at all times when taxicabs are occupying the designated taxicab spaces.
