For the purposes of this chapter, the following terms shall have the
meanings indicated:
PERSON
Includes one or more individuals, firms, partnerships, corporations
or associations or combinations thereof, including any municipal corporations.
SOLID WASTE
All materials or substances discarded or rejected as being spent,
useless, worthless or in excess to the owners at the time of such discard
or rejection, including but not limited to garbage; refuse; industrial and
commercial waste; sludges from air or water pollution control facilities or
water supply treatment facilities; rubbish; ashes; contained gaseous material;
incinerator residue; demolition and construction debris and offal; explosives;
pathological and biological waste; hazardous substance and radioactive materials;
foundry sand; sewage sludge; cesspool and other human waste; human and animal
remains; motor vehicles, including major motor vehicle parts, such as automotive
transmissions, rear ends, springs and fenders; agricultural and farm machinery
and equipment; marine vessels and major parts; any other large type of machinery
or equipment; liquid wastes; nonburnable construction material and/or demolition
debris; and hazardous waste of any kind or nature, such as cleaning fluids,
crankcase oils, cutting oils, paints, acids, caustics, poisons or drugs or
any other material having the possibility of posing a threat to health or
to safety.
No person shall deposit or cause to be deposited any solid waste within
the boundary of highways, streets, avenues or other places or in any body
of water, stream or bank thereof or on privately owned property, whether or
not such property is occupied within the Town of Salina.
No person shall operate or maintain or allow or consent to be maintained
upon any land or property rented, leased or otherwise controlled by him within
the Town of Salina any dump, dumping site or solid waste disposal area wherein
or whereon there shall be dumped any solid waste or any flammable or combustible
materials, except that the Town Board may grant permission for the maintenance
of dumps, dumping sites or solid waste disposal areas for the deposit of said
materials upon proof of compliance with applicable state and federal laws
and regulations and upon such further terms and conditions as it may deem
proper.

Any person violating any provision of this chapter shall be liable to a penalty set in accordance with Chapter
1, Article
II, General Penalty. Each 24 hours during which said violation shall continue shall constitute a separate and distinct violation within the meaning of this chapter. In addition, and not in lieu thereof, a violation involving solid waste of in excess of 40 pounds in weight or 30 gallons in volume, inclusive of any container or bag, shall be liable to an additional penalty of $500 for each such increment of weight or volume (e.g., 80 pounds or 60 gallons carries a penalty of $1,000), plus the cost or fee, if any, for the proper disposal or recycling of such waste as mandated by applicable law. Each twenty-four-hour period during which such violation shall continue shall constitute a separate and distinct violation within the meaning of this chapter.
This chapter shall not apply to existing landfill or solid waste disposal
sites or transfer stations or to ordinary trash or rubbish removal.
