Each department director shall:
A. Direct
the performance of all duties and responsibilities required of his
department or its subordinate agencies as provided by statute, this
chapter or other ordinances or resolutions of the Borough and such
other duties as may be required or requested by the Borough Manager
which are not in conflict with law, ordinances or resolutions.
B. Be
immediately responsible to the Borough Manager, the Mayor and/or Borough
Council, as the case may be, for the effective administration of his
department and all activities assigned to it.
C. Subject
to provisions of civil service law; department directors shall, with
the approval of the Borough Manager, the Mayor and/or Borough Council,
as the case may be, appoint and remove subordinate officers and employees
within their respective departments.
D. Prescribe
the internal organization of the department and the duties of subordinate
officers and employees of the department with the approval of the
Borough Manager, the Mayor and/or Borough Council, as the case may
be.
E. Assign
functions, powers and duties to subordinate officers and employees
within the department and modify such assignments as needs appear.
F. Supervise
the work of the department through the provisions provided by this
chapter and such other organization units as the director may find
necessary or desirable and supervise and direct the work of the employees
of the department.
G. Delegate
such of his powers as he may deem necessary for efficient administration.
H. Provide,
under the direction and with the approval of the Borough Manager,
to any department or subordinate agency such service, labor, materials
and equipment as may be requisitioned by such department or subordinate
agency and as its own facilities permit, through the procedures established
by ordinance or resolution.
I. Submit
monthly and annual reports to the Borough Manager of programs and
accomplishments of his department and such other reports as may be
required.
J. Keep
informed on advances in administrative and operational practices in
his respective field and institute within his department those practices
he deems in the best interests of the Borough.
K. Establish
and supervise such in-service training programs as he deems desirable
or necessary for the improvement of services to the public.
The Department of Administration shall be headed and supervised
by the Borough Manager. The Department shall perform the administrative
service functions for the Borough, its departments and agencies not
otherwise provided for in this chapter. The areas of responsibility
of the Department of Administration shall include:
A. Recording,
filing, indexing and safekeeping of all proceedings of Borough Council.
B. Maintenance
of records and files of general application to Borough operations,
its departments and agencies.
C. Supervision
of personnel policies and practices as established by Borough Council.
D. Administration
of a centralized purchasing system for all departments of Borough
government.
E. Development
of the fiscal aspects of the capital improvement and development programs
of the Borough.
F. Preparation
of the annual operating budget.
G. Tabulation
of all departmental reports.
H. Administration
of planning, zoning, building, housing, plumbing and fire prevention
matters, except to the extent that the same, under law or under any
other section of this chapter, are otherwise administered.
I. General
supervision over all officers of the Borough regarding the proper
management of the fiscal concerns of their respective offices.
J. The
administration direction and supervision of Borough property.
K. Such
other functions as shall be reasonably assigned to this Department
from time to time.
The Department of Public Works shall be headed and supervised
by the Borough Manager. The areas of responsibility of the Department
shall include:
A. Highway
Division. The Highway Commissioner shall cause the following to be
performed:
(1) The administration, direction and supervision of streets, sidewalks
and bridges.
(2) The administration, direction and supervision of storm and sanitary
sewers.
(3) The administration, direction and supervision of snow and ice control.
(4) The collection, transportation and disposal of all garbage, trash,
rubbish and refuse.
(5) Erection and maintenance of all parking and traffic control signals,
devices, signs and markings.
(6) Such other functions as shall be reasonably assigned to this Division
from time to time.
B. Engineering
Division. The Borough Engineer shall cause the following to be performed:
(1) Prepare plans, specifications and estimates for all Borough engineering
work.
(2) Furnish Borough Council with reports, information or estimates on
any Borough engineering work or on questions submitted by any member
of Council in his capacity.
(3) Inspect and approve all municipal improvements and execute all certificates
of commencement and completion in regard thereto.
(4) Have charge and direction of all surveys.
(5) Such other functions as shall be reasonably assigned to this Division
from time to time.
The Volunteer Fire Department shall be headed by the Fire Chief
and shall continue to operate as before. The Department of Administration
shall coordinate activities of the Fire Department requiring action,
support or cooperation by and of the Borough.

The Police Department, except as otherwise provided by this
chapter, the Borough Code or general law, shall be headed by the Chief
of Police and may be composed of the following subordinate officers
and classifications: Deputy Chiefs, Captains, Commanders, Lieutenants,
Sergeants, Corporals, Detectives and patrolmen. The responsibilities
of the Department shall, in addition to the customary law enforcement
function, include:
A. General
preservation of public order.
B. Prevention
and suppression of crime.
C. Apprehension
of violators of the law.
D. Protection
of life and property.
E. Traffic
and pedestrian control and safety.
G. Maintenance
of police records and files.
I. Coordination
of police programs and services with other agencies.
J. Staff
assistance to the Civil Service Board.
K. Such
other functions as shall be reasonably assigned from time to time.
The Department of Tax Collection shall be headed and supervised
by the Tax Collector. The areas of responsibility of the Department,
to the extent consistent with general law, shall include:
A. Supervision
over revenue collection functions, except for such revenues that,
pursuant to the ordinance governing the same, are collected by another
office or officer.
B. Issuance
of such financial reports as are deemed appropriate and necessary
by Borough Council or the Borough Manager.
C. Such
other functions as shall be reasonably assigned from time to time.
Borough Council shall appoint annually by resolution prior to
the commencement of each fiscal year an Auditor who shall be a certified
public accountant, a firm of certified public accountants, a competent
independent public accountant or firm of independent public accountants
to audit the accounts and other evidences of financial transactions
of the Borough of Jenkintown and the Borough officials for the fiscal
year then closing, such audit to be submitted in a report to Borough
Council. The areas of responsibility of the Auditor shall be as follows:
A. Annually examine, audit and settle all accounts whatsoever in which
the Borough is concerned.
B. Audit the accounting records of the Borough for the fiscal year and
shall prepare a report on the examination which shall set forth:
(1) The scope of his examination.
(2) His opinion of the fairness of the presentation of the financial
statement of the Borough which shall show a complete statement of
the financial condition of the Borough, giving in detail the actual
indebtedness, the amount of the funded debt, the amount of the floating
debt thereof, the valuation of taxable property therein, the assets
of the Borough with the character and value thereof and the date of
the maturity of the respective forms of funded debt thereof.
(3) The amount of any balance or shortage or any expenditure of any kind,
or made in a manner prohibited or not authorized by a statute which
came to his attention during the course of his examination and which,
in his opinion, causes a financial loss to the Borough, which loss
is material in relation to the receipts and disbursements of the Borough,
and such amount shall be a surcharge against any officer against whom
such balance or shortage shall appear.
C. File a copy of the report with the Secretary of the Borough and the
Clerk of the Court of Common Pleas of the county and the Department
of Community Affairs not later than 90 days after the close of the
fiscal year.
D. Publish within 10 days thereafter, by advertisement in at least one
newspaper of general circulation in the Borough, a concise financial
statement setting forth the balance in the treasury at the beginning
of the fiscal year, all revenues received during the fiscal year by
major classifications, all expenditures made during the fiscal year
by major functions, the current resources and liabilities of the Borough
at the end of the fiscal year, the gross liability and net debt of
the Borough, the amount of the assessed valuation of the Borough,
the assets of the Borough with the character and value thereof, the
date of the last maturity of the respective forms of funded debt and
the assets in each sinking fund.
E. Such other functions as shall be reasonably assigned to this office
from time to time.
Borough Council shall appoint a Health Officer pursuant to Article
XXXI of the Borough Code. The Department of Administration shall coordinate activities
of the Health Officer requiring action, support or cooperation. The
responsibilities of the Health Officer shall be as follows:
A. To enforce the laws of the commonwealth, the regulations of the State
Department of Health and all ordinances or resolutions of the Borough
enacted to prevent the introduction and spread of infectious or contagious
disease.
B. To abate and remove all nuisances which the Health Officer shall
deem prejudicial to the public health.
C. To mark infected houses or places.
D. To recommend rules for the construction and maintenance of housedrains,
wash pipes, soil pipes and cesspools.
E. To recommend all such other rules and regulations as shall be deemed
necessary for the preservation of the public health.
F. Such other functions as shall be reasonably assigned to this office
from time to time.
The Borough Manager shall be the Borough Secretary, ex officio.
The responsibilities of the Borough Secretary shall be as follows:
A. Attend all meetings of the Borough Council and shall keep full minutes
of its proceedings.
B. Transcribe the bylaws, rules, regulations and ordinances adopted
into a book kept for that purpose.
C. Preserve the records and documents of the Borough and have custody
of the corporate seal.
D. Certify copies of any book, paper, record, bylaw, rule, regulation,
resolution, ordinance or proceeding of the Borough, under the seal
thereof.
E. Attest the execution of all instruments, record all ordinances and
attest the same by his signature.
F. File or record proof of service of all notices required by law.
G. Such other functions as shall be reasonably assigned to this office
from time to time.
Borough Council shall appoint a Borough Solicitor pursuant to
Section 1116 of the Borough Code. The responsibilities of the Borough Solicitor shall be
as follows:
A. Prepare or approve such bonds, obligations, contracts, leases, conveyances,
ordinances and assurances to which the Borough or any department thereof
may be a party.
B. Commence and prosecute all actions brought by the Borough for or
on account of any of the estates, rights, trusts, privileges, claims
or demands, as well as defend all actions or suits against the Borough,
or any officer thereof, wherein or whereby any of the estates, rights,
privileges, trusts, ordinances or accounts of the Borough, or any
department thereof, may be brought in question before any court in
the commonwealth.
C. Furnish the Council, or committees thereof, the Mayor or the Borough
Manager with his opinion in writing upon any question of law which
may be submitted by any of them in their official capacities.
D. Such other professional acts incident to the office which he may
be authorized or required to do from time to time.
There shall be appointed a Borough Treasurer whose responsibilities
shall be as follows:
A. Keep a just account of all receipts and disbursements and annually
submit his account to the Borough auditors.
B. Pay over all moneys remaining in his hands and deliver to his successor
all books, papers, accounts and other things belonging to the Borough.
C. Deposit all moneys received by him in a bank or banking institution
in the name of the Borough.
D. Such other functions as shall be reasonably assigned to this office
from time to time.
The Borough may establish such authorities, boards and commissions
as authorized by general law and such additional boards and commissions
as the Borough Council shall deem necessary or appropriate. Unless
prohibited by statute, authorities, boards and commissions shall be
attached to an appropriate Borough department for administrative purposes
as provided by Borough Council. Borough Council may also provide for
the appointment of the Borough Manager as an ex officio member of
various authorities, boards and commissions.
