The following schedule of fees is hereby established with respect to licenses, permits and activities required or regulated under the provisions of various chapters of the Code of the Borough of Kutztown. Applications for and the issuance of such licenses and permits shall be subject to the provisions of the specific chapter of the Code which is indicated for each type of license or permit. The business, activity or operation for which the license or permit is required shall be subject to all regulations set forth in the chapter to which reference is made. These fees may be adopted or revised by the Borough Council from time to time.

A. 
Article I, Code Appeals Board, § 12-8A, Appeals, hearings and procedure. The appeal fee for an appeal to or request for hearing before the Code Appeals Board shall be the sum of $200. An application for hearing to the Code Appeals Board shall be accompanied by the above noted appeal fee. An additional fee in the amount of $175 shall be charged the appellant for the scheduling of any special hearing on a date other than the regularly scheduled monthly meeting dates of the Code Appeals Board, in order to reimburse the Borough for additional advertising and legal costs. No such special hearing shall be scheduled and advertised until the fee is received. Upon the payment by the Borough of all allowable costs associated with the appeal, any unused portion of such fees shall be returned to the appellant. In the event that the allowable costs exceed the amount of such fees, the appellant shall be billed for such costs, and in the absence of payment of the excess allowable costs by the appellant, such excess allowable costs may be collected by the Borough from the appellant in the manner provided by law.
B. 
Article II, Housing License Appeals Board, § 12-28A, Appeals, hearings and procedure. The appeal fee for an appeal to or request for hearing before the Housing License Appeals Board shall be the sum of $200. An application for hearing to the Housing License Appeals Board shall be accompanied by the above noted appeal fee. An additional fee in the amount of $175 shall be charged the appellant for the scheduling of any special hearing on a date other than the regularly scheduled monthly meeting dates of the Housing License Appeals Board, in order to reimburse the Borough for additional advertising and legal costs. No such special hearing shall be scheduled and advertised until the fee is received. Application. This rate schedule is for purchase by the Borough of net customer-generated electricity at month end when the customer-generated kilowatt hours exceed the kilowatt hours of electricity supplied by the Borough.
(b) 
Net monthly buyback rate: $0.04061 per kwh for each kwh.
(c) 
Application provisions. This rate schedule applies to all customer classes.
(2) 
Rate Schedule RG: General Residential Service.
(a) 
Application. This rate schedule is for single-phase residential service in accordance with the application provisions hereof.
(b)

Levelized budget billing. Levelized budget billing is available at the option of the customer. When a customer elects budget billing, the Borough will bill the customer each month an amount approximately equal to 1/11 of the estimated annual billing with appropriate periodic adjustments made, and a twelfth-month payment sufficient to cover the balance owing for a full year so the total for each twelve-month billing cycle will equal the actual charges under the rate for the same twelve-month billing period. In order to qualify for levelized budget billing, the customer must have a twelve-month billing history at the same service location with the Borough. At the discretion of the Borough Manager, if customers are late or delinquent in paying bills or are determined to be a credit risk, customers may be removed or denied the option of levelized budget billing.

Rate Schedule RH: Residential Service With All Electric House Heating.

Application of schedule. This rate schedule is for single-phase residential service in accordance with the application provisions hereof, when electricity is the sole source of energy for space heating, cooking and water heating.

Water heating requirements. Where necessary, the Borough furnishes and maintains one transformation from line voltage to a lower Borough standard service voltage.

The all-electric rate applies to those facilities where electricity is the sole source of energy for space heating, ventilating, air conditioning, cooking, water heating, lighting and power requirements. The not-all-electric rate applies to those facilities where only a portion of the energy needs are supplied by electrical energy.

The facilities for electric space heating are, in the Borough's judgment, a significant and integral portion of the customer's total energy requirement to be supplied hereunder.
[b] 
Service supplied hereunder includes all energy requirements on the customer's premises in a building.
[c] 
All service in one building is supplied at one voltage from one service connection.
[d] 
Another form of energy may be used for emergency lighting generators and, upon Borough approval, for other similar uses.
[e] 
When the customer occupies an entire building, service hereunder may include uses of service outside the building only when they are directly incident to the principal use of service in the building.
[2] 
Supplemental use of renewable energy sources such as wood, solar, wind and water is permitted in conjunction with service supplied hereunder without violating the total electric energy requirement of the rate. Any customer system of this type that produces electric energy may not be operated concurrently with service supplied by the Borough except under written agreement setting forth the conditions of such operation.
(8) 
Rate Schedule KF: Large General Service at 69,000 Volts or Higher.
(a) 
Application of Rate Schedule KF. This rate schedule is for large general service supplied from available three-phase lines of 69,000 volts or higher, with the customer furnishing and maintaining all equipment necessary to transform the energy from the line voltage.

The KF rate shall be a block rate consisting of three rate levels:

The charge shall be based on the customer’s peak load contribution to the Borough’s PJM planning year peak load determinant for PJM reliability pricing model capacity charges. The charge shall be the product of the customer’s fixed peak load contribution, as determined by the Borough, and the Borough’s reliability pricing model capacity charge, incurred by the Borough, expressed in dollars per kilowatt-month.

The customer’s fixed peak load contribution shall be determined using load data from the previous planning year. In the event the load data is not available, the Borough will estimate the customer fixed peak load contribution.

For June 1, 2013, through May 31, 2014, the reliability pricing model capacity charge shall be $6.88 per kw-month and the fixed peak load contribution shall be 1,443 kw.
(d) 
The Pennsylvania state tax is applied as required by the Pennsylvania Department of Revenue.
(e) 
Advanced meter monitoring service fee: If the Borough offers and the customer subscribes to an advanced meter monitoring service, the fee shall be $78 per month.

Rate Schedule DD: Private Area Lighting Service.
(a) 
Application of Rate Schedule DD. This rate schedule is for the lighting of yards, private roadways, alleys and other areas supplied from existing overhead secondary distribution.

A mercury vapor lamp of a nominal 6,650 lumens (175 watts), a high-pressure sodium lamp of a nominal 16,000 lumens (150 watts) or a high-pressure sodium lamp of a nominal 25,500 lumens (250 watts) is installed in a luminaire on a bracket. Lamp replacements are normally made on the first working day after outage notification by the customer to the Borough office. There is no credit for outages.

The Borough installs up to one span of secondary not exceeding 150 feet from an existing secondary voltage supply and one pole for each lamp, provided the location of the pole is accessible by a service truck for the installation and maintenance of the lamp and provided the Borough is furnished a suitable right-of-way.

Upon request and at the Borough's discretion, the Borough may install an area light fixture on a suitable customer-owned support.
[5] 
Where a secondary supply is not available at the desired lamp location and/or where the distance is more than one span, the Borough may furnish the service, provided the customer reimburses the Borough for the Borough's estimated added investment required to supply the service in each case.
(10) 
Payment schedule and contract period for all rate schedules.
(a) 
Payment. The above net rates apply when bills are paid on or before the due date specified on the bill. After the due date, the Borough may initiate collection procedures. A late payment charge of 10% will be applied on the unpaid balance of the current monthly bill if payment is not received on or before the due date.
(b) 
Contract period: not less than one year.
D. 
Section 107-8, guaranty of payment.

Restoration fees cover the cost for the Borough to make necessary temporary and permanent restoration of trenches. A deposit of the required fee by the applicant shall be held by the Borough to guarantee that the restorations have been made. If the restorations are to be made by the Borough, the deposit shall be used to cover the cost to make the restorations. The fees for said restorations are as follows:

(5) 
Bonding of public utilities.
(a) 
Public utility corporations operating under a franchise within the Borough shall have on file with the Borough a bond in the amount of $5,000 each year, covering all openings or excavations made or to be made in a calendar year, or shall furnish a bond in the amount determined by the Borough covering the proposed openings or excavation set out in the application. The aforesaid bonds shall have either corporate surety or surety approved by the Borough Solicitor and shall be conditioned to indemnify the Borough in the event of any loss, liability or damage that may result or accrue from or because of the making, existence or manner of guarding or constructing any such opening or excavation during the term of said bond.
(b) 
Said bonds shall be approved or disapproved by the Borough Solicitor, the proper fee determined by a duly adopted resolution of the Borough Council. The bond shall then be filed with the Borough Superintendent.
(6) 
Borough authorities exempt. Any municipal authority created by the Borough shall be exempt from the permit fees, general permit inspection fees, additional inspection fees, temporary and permanent restoration fees and bonds of public utilities as provided herein. Borough authorities, however, are not exempted from obtaining a permit as provided for in the Kutztown Borough Street Occupancy Ordinance.
(7) 
Blasting bond amounts: When blasting will be required, a blasting bond shall be provided in the following amounts:

Section 195-43, Subdivision and land development filing fee schedule.
(1) 
Review of a residential subdivision having:
(a) 
Ten or more dwelling units or lots: $1,000 plus $40 for each dwelling unit or lot.
(b) 
Fewer than 10 dwelling units or lots: $500 plus $40.00 for each dwelling unit or lot.
(2) 
Review of a commercial or industrial subdivision: $1,000 plus $150 for each acre or fraction thereof.
(3) 
Review of land development: $1,000 plus $500 for each acre or fraction thereof over one acre.

Section 212-13.1, Penalties for violations of proclamations issued by Mayor (other than penalties for violations covered by the Vehicle Code of the Commonwealth of Pennsylvania or other sections of Chapter 212): $25.

Section 212-26, Metered parking.
(1) 
The parking rates and the length of time that parking is permissible in any individual parking space shall be regulated by the meter or kiosk immediately adjacent thereto. Notice thereof shall be given to the public, stating the length of time during which parking is permitted and the conditions regulating the same, by either placing said notice on the parking meter or kiosk or in the immediate vicinity of said parking facility.

An application for an appeal shall be accompanied by the above - noted fee/deposit. Upon payment by the Borough of all costs associated with the appeal, any unused portion of the fee/deposit shall be returned to the applicant. In the event that the costs exceed the fee/deposit, the applicant shall be billed for such costs, and in the absence of payment of the excess costs by the applicant, such costs may be collected by the Borough from the applicant in the manner provided by law.

B. 
Pursuant to Chapter 220, no action shall be taken on any application or appeal until all applicable fees, charges and expenses have been paid in full. Therefore, no special inspections (as described hereinabove) shall be commenced until the applicant shall have deposited with the Borough Code Enforcement Office a sum equal to the estimated cost (as determined by the Code Enforcement Officer) of conducting such special inspections. Further, no determination of an application, nor any special permit, shall be issued until all fees, charges and expenses imposed herein have been paid in full.
C. 
The form "Wellhead Protection Permit Application" annexed hereto, marked as "Exhibit A," and incorporated herein by reference is hereby approved as the form of application for use pursuant to Chapter 220.[1]

Other Engineering Consultants: Such fees, charges and expenses shall be at cost plus 10% as received from such Consultants.
C. 
Other Engineering Consultants. Such fees, charges and expenses shall be the same as the charges incurred by the Borough of Kutztown for such Consultants.
D. 
Miscellaneous Charges and Disbursement Expenses. Miscellaneous charges and disbursement expenses incurred by the Borough for the services of the above-noted Consultants in the performance of the reviews and reports required by Chapter 195, Subdivision and Land Development, Chapter 189, Stormwater Management, and Chapter 123, Floodplain Regulations, of the Code of the Borough of Kutztown shall be charged to the developer/applicant at the same rate as charged to the Borough for such expenses.
E. 
Such fees, charges and expenses as herein listed shall be the same as would be charged to the Borough when such fees, charges and expenses are not reimbursable. Such fees, charges and expenses as herein listed shall be on file and available upon request to the Developer/Applicant for review.
F. 
The Borough of Kutztown reserves the right to adopt additional fees, charges and expenses, and to modify the fees, charges and expenses listed herein. Upon adoption or modification of this resolution, any and all Developers and/or Applicants currently being charged for such services, as allowed by the Pennsylvania Municipalities Planning Code, as from time to time amended, shall be notified of such within 10 days of adoption.
G. 
Capitalized terms used herein without definition shall have the meanings attributed thereto by the Pennsylvania Municipalities Planning Code and/or Chapter 195, Subdivision and Land Development, Chapter 189, Stormwater Management, and Chapter 123, Floodplain Regulations, of the Code of the Borough of Kutztown, as appropriate.
