As used in this chapter, the following terms shall have the meanings indicated:
BONFIRES
An outdoor fire for pleasure, religious, ceremonial, warmth, or other similar purposes. The location shall not be less than 50 feet from any structure, property line, or combustible materials. A property owner shall make all necessary provisions to prevent the fire from spreading to within 50 feet of any structure, property line, or combustible materials. A property owner must first obtain a permit from the Limerick Township Fire Marshal's office before any bonfires shall be allowed to commence on their property. Bonfires shall not burn yard, household, or leaf waste.

PERSON
Any individual, firm, partnership, association, corporation, company or organization of any kind or nature.
RECREATIONAL FIRE
An outdoor fire not contained in an incinerator, outside fireplace, approved certified outdoor appliance, barbeque grill, or barbeque pit which has a total fuel area of three feet or less in diameter and two feet or less in height for pleasure, religious, ceremonial, cooking, warmth, or similar purposes. Recreational fires shall not be conducted within 50 feet from any structure, property line, or from any combustible materials. Recreational fire shall not burn yard, household, or leaf waste.

A. 
No person shall burn, cause or allow the burning of any household, business or industrial waste within the limits of Limerick Township.
B. 
Exceptions:

(1) 
Burning to prevent or abate a fire hazard and control of disease or pests which has been approved by the Limerick Township Fire Marshal's Office.

(2) 
Burning for the purpose of instructing personnel in firefighting.
(3) 
Burning in conjunction with the production of agricultural commodities in their unmanufactured state on the premises of the farm operation.

With the exception of recreational fires and bonfires, there shall be no burning at nighttime.

All other burning not prohibited under this chapter shall be authorized by proper notification of intent to burn having been given to the Fire Code Official. Said notification shall set forth the proposed time of burning, material to be burnt, and a plot plan showing they meet the exception in § 66-2.
All burning authorized under the terms of this chapter will be accomplished without affecting adversely in any manner or to any degree the health or safety of any person in Limerick Township or the safety of any property, real or personal, within Limerick Township.

It shall be the duty of the Limerick Township Fire Code Official to enforce the provisions of this chapter, provided that no action shall be instituted on private complaint without the delivery of a signed written complaint to the Limerick Township Fire Code Official by the complaining person or persons prior to the institution of any enforcement proceeding.

Any person who shall violate or fail to comply with any of the provisions of this chapter shall, upon conviction, be sentenced to pay a fine of not more than $1,000 plus costs of prosecution and, in default of payment of such fine and costs, shall be committed to the county jail for a period not exceeding 30 days.
