As used in this article, the following terms shall have the meanings indicated:
EMERGENCY
A set of circumstances by which there is imminent danger of a collision with persons, property and/or animals.
ENGINE BRAKE
Any mechanical exhaust device designed to aid in the braking, decompression or deceleration of any motor vehicle. Also known as "compression release brake" or by the trademark "Jake brake."
It shall be unlawful for the operator and/or owner of any motor vehicle to operate or use an engine brake on an internal-combustion-engine-powered vehicle on any public highway established for motor vehicle operation within the Township without an exhaust muffler sufficient to prevent the creation of a loud, unnecessary or unusual noise, or noise which does or is likely to annoy, disturb or injure or endanger the comfort, repose, peace or safety of others, except when the use of such engine brake is necessary in an emergency. Said prohibition is not intended to prohibit operation of such vehicles within the Township if equipped with an appropriate muffler for use with an engine brake to prevent the above-described noise.
Any person violating or failing to comply with any of the provisions of this article shall, upon conviction thereof, be punishable by a fine of not more than $1,250, or by imprisonment for a term not to exceed 90 days, or by both such fine and imprisonment, in the discretion of the judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
