Dogs, whether licensed or not, shall be subject to the following restrictions:
A. 
No person owning or having custody and control of a dog shall permit such dog to be at large in the City of Gloversville elsewhere than on the premises of the owner, except if it is on the premises of another person with the knowledge and consent of the owner.
B. 
The owner or person having custody and control of a dog in the City of Gloversville, which dog is not on the premises of the owner or upon the premises of another person with the knowledge and consent of such person, shall control and restrain such dog by a leash not exceeding six feet in length.
C. 
The fact that a dog is at large in the City of Gloversville elsewhere than on the premises of the owner shall be presumptive evidence that the dog has been permitted to be at large with the knowledge of the owner or person having custody and control of the dog.
D. 
No person shall tie a dog to a leash or a line where said leash or line comes within two feet of any City sidewalk, street, or road.

Any person violating any provision of this article may be punishable as follows:
A. 
First offense: a fine not less than $50 and not greater than $500 or incarceration for a period of not more than 15 days, or both.
B. 
If the defendant has a prior conviction of any violation under Chapter 82 of the Gloversville City Code within five years of the issuance of a new violation under Chapter 82 of the Gloversville City Code, the defendant shall be subject to a fine not less than $300 and not greater than $1,500 or incarceration for a period not greater than 15 days, or both.
C. 
If the defendant has more than one conviction of any violation under Chapter 82 of the Gloversville City Code within five years of the issuance of a new violation under Chapter 82 of the Gloversville City Code, the defendant shall be subject to a fine not less than $500 and not greater than $2,500 or incarceration for a period not greater than 15 days, or both.
