A.
No person
shall permit any dog to be at large on any street or public place
in the City of Gloversville if dangerous.
B.
A "dangerous
dog," for purposes of this article, is any dog which:
(1)
When
unprovoked, approaches a person engaged in lawful conduct in a vicious
or terrorizing manner, in an apparent attitude of attack threatening
injury to said person, his/her property or his/her domestic animals,
and behaves in a manner that causes reasonable apprehension of bodily
harm or injury to any person, his/her property or domestic animal
while the dog is off the owner's property.
(2)
Bites,
inflicts injury, assaults or otherwise attacks a human being engaged
in lawful conduct or a domestic animal or household pet, without provocation,
while the dog is off the owner's property; or while upon the owner's
property, bites or inflicts upon a business invite or lawful guest.
(3)
Any
dog previously adjudicated to be a dangerous dog pursuant to Agriculture
and Markets Law § 123.

Any person found in violation of any provision of Chapter 82 of the Gloversville City Code shall be subject to the following penalties:
A.
First offense:
a fine not less than $50 and not greater than $500 or incarceration
for a period of not more than 15 days, or both.
B.
If the defendant has a prior conviction of any violation under Chapter 82 of the Gloversville City Code within five years of the issuance of a new violation under Chapter 82 of the Gloversville City Code, the defendant shall be subject to a fine not less than $300 and not greater than $1,500 or incarceration for a period not greater than 15 days, or both.
C.
If the defendant has more than one conviction of any violation under Chapter 82 of the Gloversville City Code within five years of the issuance of a new violation under Chapter 82 of the Gloversville City Code, the defendant shall be subject to a fine not less than $500 and not greater than $2,500 or incarceration for a period not greater than 15 days, or both.
