Council, the Mayor and the Auditors shall have
the power to authorize and conduct investigative hearings into the
affairs of the Municipality and into the conduct of any municipal
department, administrative unit, office or agency.
The officials aforesaid, independently, may from time to time adopt rules governing the hearing procedures subject to the provisions of §
C-48 of this Charter.
The officials aforesaid may compel the attendance
of witnesses and the production of books, papers or other evidence
at investigative hearings and, for that purpose, may issue subpoenas
signed by any of the officials aforesaid and cause the same to be
served in any part of the Commonwealth of Pennsylvania in accordance
with applicable law pertaining to the service of subpoenas.
The official presiding at any hearing held pursuant
to this article shall have the power to administer oaths or affirmations
to witnesses.
If any person shall refuse or neglect to obey
any subpoena issued by the official, that person shall, upon conviction
thereof at a summary proceeding, be sentenced to pay a fine as may
be ordained and, in default of the payment of such fine and costs,
shall be imprisoned not to exceed 30 days.
If any person shall refuse or neglect to obey
any subpoena issued by the official, the official may apply by petition
to the Court of Common Pleas for its subpoena, requiring the attendance
of that person before the official or the court.
