The following sections of the International Mechanical Code, adopted in §
165-1, are hereby revised:
A. Section 101.1 Title. Insert "Township of Nether Providence"
as the name of the jurisdiction.
B. Section 106.5.2 Fee schedule. Insert: "A fee for each
plan review, permit, inspection and testing under the provisions of
the code shall be paid in accordance with the schedule as determined
from time to time by the Board of Commissioners of the Township of
Nether Providence."
C. Section 106.5.3 Fee refunds. Insert "75%" as the percentage
of the permit fee refunded when no work has been done under a permit
issued in accordance with this code and as the percentage of the plan
review fee refunded when an application for a permit for which a plan
review fee has been paid is withdrawn or canceled before any plan
review effort has been expended.
D. Section 108.4 Violation penalties. This section is
deleted and replaced by the following:
"Any person who shall violate a provision of this code or shall fail to comply with any of the requirements of the code or who shall construct, erect, install, alter, repair, locate, relocate, replace, add, use or maintain a mechanical system in violation of an approved plan or directive of the Code Enforcement Officer or of a permit issued under the provisions of the code shall, upon conviction thereof, be punishable as provided in Chapter 1, General Provisions, Art. II, Violations and Penalties, § 1-16, Building, health and safety violations. Each day that a violation continues shall be deemed a separate offense."

E. Section 108.5 Stop-Work Orders. Insert "$500" as the
minimum fine and "$1,000" as the maximum fine for violating a stop-work
order.
F. Chapter 16 Codes. Insert "The 1996 BOCA National Building
Code; The 1996 BOCA National Fire Prevention Code."
This chapter shall be supplemented by Chapter
28 (Mechanical Systems) of the 1996 National BOCA Building Code. Whenever
a conflict exists between these two documents, the more restrictive
standard shall apply.
Nothing in this chapter or in the International Mechanical Code hereby adopted shall be construed to affect any other suit or proceeding pending in any court or any rights acquired or liability incurred or any cause or causes of action acquired or existing under any act or ordinance hereby repealed as cited in §
165-2 of this chapter, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
