A. 
Unless otherwise expressly stated, the following words and phrases shall be construed throughout this article to have the meaning indicated in this article.
COMMERCIAL USER
An owner or lessor of a commercial use as specifically allowed under Chapter 370, Zoning.
GARBAGE
All table refuse, animal and vegetable matter, offal from meat, fish, fowl, fruits, vegetables and parts thereof, and other articles and materials ordinarily used for food which have become unfit for such use or which are for any reason discarded.
MULTIFAMILY USER
An owner or lessor of a multifamily residence having more than five units.
RUBBISH
Discarded articles, materials, or refuse, including garbage, ashes, combustible and noncombustible waste, abandoned or junked vehicles.
B. 
The present tense shall include the future; the singular number includes the plural and the plural the singular, except that such interchange of meaning shall not apply where numbers in the text refer to specific, minimum or maximum quantities; the masculine gender includes the feminine and neuter; the word "person" includes any individual, partnership, firm, association, corporation or organization; and the word "shall" is always mandatory. The word "Township" means North Coventry Township, Chester County, Pennsylvania.
Rubbish and garbage containers shall be provided by commercial and multifamily users. The rubbish and garbage containers shall be in good condition and of sufficient capacity and material to contain all rubbish and garbage on the premises of said multifamily user and commercial user.
No commercial or multifamily user shall place or allow to be placed any rubbish or garbage from the premises of said user in any street, alley or public place or upon any private property whether owned by such user or not, within the Township except it be in proper containers for collection and/or disposal.

No commercial or multifamily user shall allow any rubbish and/or garbage to be littered around rubbish and garbage containers or to allow the overflowing of rubbish and garbage from rubbish and garbage containers. All rubbish and garbage containers shall be maintained in good condition and shall be equipped with suitable, tight-fitting covers which shall be maintained on said containers while in use.
Any person who violates or permits a violation of this article shall, upon being found liable therefor in a civil enforcement proceeding commenced by the Township before a Magisterial District Judge, pay a fine of not more than $600, plus all court costs, including reasonable attorney's fees, incurred by the Township in the enforcement of this article. No judgment shall be imposed until the date of the determination of the violation by the Magisterial District Judge. If the defendant neither pays nor timely appeals the judgment, the Township may enforce the judgment pursuant to the applicable Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense. Further, the appropriate officers or agents of the Township are hereby authorized to seek equitable relief, including injunction, to enforce compliance herewith.
