It shall be unlawful for any individual, partnership,
limited partnership, association, firm or corporation to own, lease,
operate or maintain any single automatic protection device or alarm
within the Borough of Wilson, so as to permit such device to register
more than three false alarms in any one-year period.
The owner or lessee of any building, structure
or facility from which more than three false alarms are received within
a period of one year from any single automatic protection device or
alarm shall be charged a fee for service from the Borough of Wilson
in responding to such alarm in the amount of $300 for the fourth and
each subsequent false alarm in the one-year period.
Bills for the above service charge shall be
sent to the above described liable party, and, if payment is not made
in full within 30 days from the date of mailing of said bill, the
matter shall be turned over to the Borough Solicitor for collection.
As used in this article, the following terms
shall have the meanings indicated:
FALSE ALARM
Any alarm coming into the fire station which requires men
and/or equipment to respond to the location, without there then existing
a condition or situation for which the alarm was intended.
ONE-YEAR PERIOD
The period commencing on the date the first false alarm is
received from any single automatic protection or alarm and ending
365 days later.
Any individual, partnership, limited partnership,
association, firm or corporation violating this article shall, upon
conviction thereof in a summary proceeding before a District Justice,
be sentenced to pay a fine of not less than $10 or more than $300,
together with costs of prosecution and, in default thereof undergo
imprisonment in Northampton County Prison for not more than 30 days.
