A. 
Office of the Clerk.
(1) 
The Municipal Clerk shall serve as the Clerk of the Council and shall maintain the records and minutes of the governing body, shall perform the functions required by law of municipal clerks generally, shall perform as Registrar of Vital Statistics and shall perform improvement searches. He shall also perform other duties as may be prescribed by Council, such as:
(a) 
Maintaining personnel records of all municipal employees.

Being responsible for the operation of a purchasing system.
(c) 
Preparing an agenda for governing body meetings.[1]

(d) 
Acting as the Clerk of Elections.
(2) 
The office of Deputy Municipal Clerk is hereby created. The Deputy Municipal Clerk shall perform upon the direction of the Clerk and may act as Secretary to the Municipal Utilities Authority, Zoning Board and Planning Board, under the direction of the Clerk.

B. 
Office of the Chief Financial Officer. The Chief Financial Officer of the municipality, shall be the custodian of all municipal funds, shall keep and maintain books and records of all financial transactions, shall make a monthly report to the Mayor and Council of all receipts, expenditures, commitments and unencumbered appropriations balances, shall assist in the preparation of the annual budget, shall perform continuous cash flow analysis and shall be responsible for the investment of idle funds.

C. 
Office of the Tax Collector.
(1) 
The Tax Collector shall perform all duties as specified in N.J.S.A. 40:69A-131, as well as all general statutory duties. The Tax Collector shall also be the Tax Search Clerk.
(2) 
The office of Deputy Tax Collector is hereby created. The Deputy Tax Collector shall perform under the direction of the Tax Collector.

D. 
Office of the Assessor. The Assessor shall perform all statutory duties as specified in N.J.S.A. 54:4-12 and 54:4-23.
E. 
Office of the Municipal Court.[2]

(1) 
There is hereby established a Municipal Court within the Township of Berlin, pursuant to N.J.S.A. 2A:8-1 et seq.[3]

(2) 
The name of said Municipal Court so established shall be the "Municipal Court of the Township of Berlin."
(3) 
The Judge appointed to said Court shall have the qualifications required by statute.
(4) 
The Court shall have such jurisdiction as shall be provided by the statutes of the State of New Jersey.
(5) 
Costs and fees collected in said Court shall be delivered by the said Court to the Township Treasurer, and fines, penalties and civil costs shall be disposed of according to law.
(6) 
Municipal Court Clerk. There shall be a Clerk of the Municipal Court, who shall be appointed by the Mayor and Council to serve for a term of one year from the date of appointment and until a successor is appointed and qualified. The Clerk of the Municipal Court shall receive an annual salary as shall be fixed and determined by the annual Salary Ordinance,[4] the said salary to be paid in the same manner as the salary of other municipal officers are paid and which shall be in lieu of all fees, costs and any other allowances whatsoever.

(7) 
Deputy Court Clerk-Violations Clerk. The Municipal Court Clerk shall have a Deputy Court Clerk-Violations Clerk, who shall be appointed by the Mayor and Council and shall perform such duties as may be required of him by statute, the New Jersey Court Rules or the direction of the Municipal Judge. The Deputy Court Clerk-Violations Clerk shall receive an annual salary, which shall be paid in the same manner as the salaries of other municipal officers are paid and shall be in lieu of all fees, costs and any other allowances whatsoever.
(8) 
Municipal Prosecutor. The Mayor and Council may designate any licensed member of the Bar of the State of New Jersey as Municipal Prosecutor, whose duties shall be to appear before the Municipal Court in all cases, where requested, and to present to and prosecute said cases before the Court, and to assist the general public and the Police Department in the preparation of complaints, when requested by the Chief of Police or such person acting on his behalf. The Mayor and Council may from time to time provide for the compensation of the Municipal Prosecutor.
(9) 
Public Defender.

(a) 
Fee for representation. All persons seeking and applying for representation by the Berlin Township Municipal Public Defender shall be required to pay an application fee to the Berlin Township Municipal Court in an amount not to exceed $200.
(b) 
Waiver of fee. In the discretion of the Municipal Court Judge, and upon good cause shown by an applicant for a Public Defender, said fee may be waived upon a finding that the fee would be an unreasonable burden on the applicant seeking this representation.
(10) 
Seal. The Municipal Court shall have a seal which shall bear the impress of the name of the Court.
(11) 
Location of Court. The Municipal Court shall be held in the Berlin Firehouse, Berlin, New Jersey, or any other place as determined by resolution by the Mayor and Council.

A. 
Police Department. The Police Department, under the direction of the Chief of Police, shall be organized in such a manner and with such an assignment of personnel as the Chief shall order and shall consist of such personnel as may be authorized by the governing body. It shall be the function of the Police Department to enforce all laws and ordinances in the interest of preserving public peace and protection of life and property.
B. 
Emergency Management. There shall be a Director of Emergency Management-Disaster Control. He shall be responsible for and shall have the authority to enforce the planning, activating, coordinating and conduct of emergency operations within the municipality.
C. 
Fire prevention. The enforcement of the fire prevention regulations of the Township of Berlin shall be as previously established by local ordinance and general statutory references.

D. 
Director of Public Safety.

(1) 
The Township of Berlin Police Department shall come under the jurisdiction of the Director of the Department of Public Safety, which position is hereby created.
(2) 
The position of Director of Public Safety shall be held by the Mayor, or any Member of Council so designated. The Director of Public Safety shall serve without salary compensation.
(3) 
The Director of Public Safety shall, with the approval and consent of the Mayor and Township Council, appoint such other auxiliary policemen, auxiliary police matrons, police surgeons and crossing guards as he or they may deem necessary. They shall be a part of the Police Department established herein and subject to all the laws, rules and regulations governing the same. Said appointment shall be at the discretion of the Mayor and Township Council but in no event shall exceed one year. The personnel referred to in this subsection shall be compensated at such hourly rate as designated in the Salary Ordinance of the Township.[1] Said personnel shall serve for the appointed term only and at the compensation, if any, established by ordinance or as modified or changed by resolution of the Mayor and Township Council.

(4) 
The Director of Public Safety shall with the approval and consent of the Mayor and Township Council, appoint such civilian members of the Police Department to serve in the Services Division as he or they may deem necessary. Said members are to provide dispatching services, clerical duties and logistics and support for said Police Department. The personnel referred to in this subsection shall receive such salary and compensation as negotiated in the Civil Employment Contract and as designated in the Salary Ordinance of the Township. In addition, said personnel shall receive a uniform and equipment allowance in an amount set by the Mayor and Township Council and as fixed annually in the Township budget or as negotiated in any Civilian Employment Contract.
(5) 
In the event of any disciplinary proceedings against any member of the Police Department of the Township of Berlin, the Director of Public Safety and Township Council shall be designated as the sole hearing officer and person in charge of all such proceedings. The decision of the Director of the Department of Public Safety shall be final and binding. The right of appeal shall be to the Camden County Court pursuant to the New Jersey statutes.
(6) 
In the event of any disciplinary proceedings against the Chief of Police of the Township of Berlin, the Director of Public Safety and Township Council shall be designated as the hearing officer and in charge of all such proceedings. The decision of the Director of Public Safety and Township Council shall be final and binding. The right of appeal shall be to the Camden County Court pursuant to the New Jersey statutes.
A. 
Department of Public Works. The Department of Public Works shall be responsible for streets, roads and sanitation.
B. 
Municipal Utilities Authority. The duties of the Municipal Utilities Authority shall be as previously established by ordinance and pursuant to the provisions of N.J.S.A. 40:14B-4.[1]

C. 
Deputy Director of Public Works.

(1) 
There shall be created within the position of Deputy Director of Public Works.
(2) 
The duties and responsibilities of the Deputy Director shall include, but are not limited to, assisting the Director in all phases of operation of the Berlin Township Department of Public Works and Sewer Operations, supervising and assisting employees of the Department to complete work assignments, attendance at meetings as instructed by the Director, and assumption of the duties of the Director as necessary in the absence of the Director.
(3) 
The Deputy Director shall carry a Township beeper and/or a cell phone and shall be on call 24 hours per day, seven days per week, to answers calls as needed.
(4) 
The Deputy Director shall obtain a C-2 sewer collection operator's license, as well as a CPWM license, through the State of New Jersey in a timely manner.
(5) 
The Deputy Director shall be subject to and abide by the terms of the Public Works Contract negotiated by and for the management personnel of the department.
(6) 
The Salary Ordinance of the Township shall be amended as necessary to provide for this position.[2]

Board of Health. A Board of Health is hereby created, composed of the members of the governing body. The Board of Health shall have the powers and duties which are granted by law to municipal boards of health.[1]

Library. A free public library is hereby established as is provided by law.[2]

A. 
Planning/Zoning Board. The responsibilities of the Planning/Zoning Board are as set forth in the Planning and Zoning Ordinances of the Township,[1] as well as in the Municipal Land Use Law. The terms of office of the members of the Board are as set forth in the Municipal Land Use Law.[2]
(1) 
Planning/Zoning Board Secretary. The Secretary of the Planning/Zoning Board is hereby appointed as the administrative officer of the municipality responsible for providing a certified list of property owners pursuant to § 200-40 of this Code.

Office of Inspections.
(1) 
Building Inspector and Zoning Officer. The duties of the Building Inspector and the Zoning Officer shall be to:
(a) 
Enforce the Building Code[3] and Chapter 340, Zoning.

(b) 
Act as advisors to the Planning/Zoning Board.
(2) 
The Plumbing Inspector shall enforce the Plumbing Code.
(3) 
The Electrical Inspector shall enforce the Electrical Code.
(4) 
The Construction Official shall enforce the Construction Code.
A. 
Municipal Attorney. The Municipal Attorney shall be the chief legal officer of the municipality. He shall act as solicitor of record in Court proceedings, advise on all matters relating to the municipal government and supervise the preparation of contracts, deeds, documents and all ordinances and resolutions. He shall receive compensation based upon reasonable fees and charges, and upon approval of the governing body. He shall generally act as the lawyer for the municipality in all matters relating to legal affairs.
B. 
Municipal Engineer. The Municipal Engineer shall have full charge of matters pertaining to the business of civil or hydraulic engineering in relation to any public improvement or other public work. He shall be a licensed professional engineer in the State of New Jersey. He shall perform all engineering assignments and services as required by the Mayor and Council. He shall be paid fees commensurate with his services.
C. 
Auditor. The Auditor shall be a registered municipal accountant and shall make an annual audit of the books, accounts and financial transactions of the Township in accordance with the provisions of the Local Fiscal Affairs Law.[1] He shall perform such other services as may be requested by the Mayor or governing body. He shall receive compensation based upon reasonable fees and charges, upon approval of the governing body.

There is hereby created the position of Property Maintenance Inspector to perform all duties associated with overseeing and enforcing the various ordinances and codes in effect within the Township on property use and maintenance.

The herein-mentioned officials of the Township shall submit to the Township Clerk narrative reports, in writing, of the operations of their offices for the preceding month. These reports are due no later than five days following the end of the month. The Township Clerk will make such reports part of the official business to be reviewed at the first Township meeting following receipt of the reports.
B. 
Reports shall be required from the following:
