The State of New Jersey has had a growing concern over the failure
of landlords to provide the necessary heat to tenants in residential
rental properties containing six or more units during the winter months
and has enacted an act known as the "Emergency Fuel Oil Delivery Act"
(N.J.S.A. 26:3-31.4 et al.) to permit action by a municipality to
assist in the providing of heat to said residential rental properties
if same is not provided by the owner of said property.
The local Health Officer of the Township of Berlin shall hereby
be designated as the Township official to have the authority to apply
the provisions of N.J.S.A. 26:3-31.4 et al. (Emergency Fuel Oil Delivery
Act) to said residential rental properties as described therein in
the event such action shall become necessary.
