No person, firm or corporation shall undertake any construction work,
installation, repairs or related activity, hereinafter collectively referred
to as "construction work," in or on a public highway in the Town of North
Haven or on other property so adjacent to any such highway as to create a
traffic hazard thereon, without first obtaining a permit for such construction
work from the Building Department of the Town of North Haven.
A. Applications for such permits shall be made on forms
provided by the town, which forms shall require, in addition to such other
information as may be deemed appropriate, the name of the party performing
such construction work, a brief description of such construction work, the
time, location and date of the commencement of such construction work, the
approximate duration of such construction work and the hours of the day when
the same will be in progress.
B. As a condition to the granting of a permit for construction
work as defined above, the Chief of Police of the Town of North Haven or his
designee shall assign such police personnel to the work site as he, in his
discretion, deems necessary or appropriate to assure the safety of persons
or vehicles using said highway. If police personnel are not available for
this purpose, the Building Department of the Town of North Haven shall require
the party performing such construction work to provide such traffic guards
or flagmen as may be deemed necessary.
When any person, firm or corporation is required by any statute, ordinance or regulation to provide police protection for any activity, function, affair or gathering other than construction work as defined in §
162-1 above, such party shall make application to the Chief of Police of the Town of North Haven for the assignment of such police personnel as the Chief or his designee may deem necessary. Such applications shall be on forms provided by the Police Department of the town which shall elicit such data and information as may be deemed appropriate.
Any person, firm or corporation violating the provisions of §
162-1 or
162-2 of this ordinance shall be fined the sum of $100. Each day that such violation continues shall be deemed a subsequent offense.
When any person, firm or corporation requests police protection for any activity, function, affair or gathering other than as described in §
162-1 or
162-2 above, such party shall make application for such police protection through the Chief of Police of the Town of North Haven on forms provided by the Police Department of the town which shall elicit such data and other information as may be deemed appropriate.
Upon presentation of an invoice from the town for the costs of police
service as described above, the party requiring such service shall reimburse
the town in such amount. The costs to the town for the provision of the police
service described in this ordinance shall include the amount paid to such
police personnel, together with such other direct costs thus incurred by the
town. Payment shall be made to police personnel concerned by the town through
normal payroll processes, making proper allowance for the allocation and deduction
of taxes, social security and like matters. The town may require an advanced
deposit or bond guaranteeing the payment of the town for the costs of the
police service required herein in accordance with any requirements promulgated
by the Town Finance Director.
