No person shall engage in the business of photography as a transient or itinerant photographer, picture coupon salesman, enlargement solicitor, photo work solicitor or canvasser therefor without having first obtained a license.
A. 
All licenses shall be issued by the City Treasurer upon filing an application and payment of the license fee.
B. 
Licenses shall be issued to all persons engaged in the business of photography as a transient or itinerant photographer, picture coupon salesman, enlargement solicitor, photo work solicitor or canvasser therefor at a rate as set forth in the City of Butler Fee Schedule, adopted from time to time by resolution of the City Council,[1] to be paid in advance for the number of days the license is issued.

A. 
All persons who do not intend to engage permanently in business in the City, in the usual and ordinary course of business, shall be termed transient or itinerant.
B. 
Whenever a person coming into and setting up business in the City claims that he intends to engage in the business of photography permanently in the City and who would otherwise be classed as an itinerant photographer, such person shall file a bond in the sum of $1,000, with approved surety, conditioned that in the event that he is classified as an itinerant or transient photographer the license fee as such will be paid.

Any person who shall violate any of the provisions of this article shall, upon conviction thereof before a District Justice, be subject to a fine of up to $300 and costs of prosecution and, in default of payment of such fine and costs, shall be subject to imprisonment in the county jail for up to 90 days.
