The spraying, spreading or otherwise applying of pesticides
(including herbicides, insecticides and rodenticides) in such a manner
that said substances come in contact with the person or property of
another, including town property, shall be illegal, unless written
permission is obtained from such other party in advance. Said written
permission is to be valid for 90 days.
The following are exceptions to the provisions of this chapter:
A. United States or Massachusetts governmental public health programs.
B. Programs of the Park and Recreation Commission.
C. Programs conducted by the East Middlesex Mosquito Control Project.
Each instance of a person or property being affected or impinged
upon as described herein shall constitute a separate violation of
this chapter, except that it shall not apply to persons, or to the
personal property of persons, affected while on the premises of someone
who has either given prior written permission for, or has himself
undertaken, the application of pesticides on said premises as defined
in this chapter. For purposes of this chapter, "property" shall mean
either all contiguous real estate under the same ownership, with the
buildings, trees, etc., and all personal property thereof, or, if
no real estate, buildings, trees, etc., of a person are involved,
then any or all of his or her personal property.
