Pennsylvania-Reading Seashore Lines is hereby authorized and empowered
to lay, construct, maintain and operate railroad tracks at grade on the surface
of Penn (Fifth) Street and Howell Street, Salem, New Jersey, as industrial
sidetracks to serve the plant and property of the Anchor Hocking Glass Corporation,
which siding when constructed will extend from its connection with the Glass
Works Branch at a point approximately seventeen (15) feet northeast of Howell
Street, across Howell Street and Penn (Fifth) Street, at grade, as shown in
yellow on the aforesaid plan.
Pennsylvania-Reading Seashore Lines is hereby authorized to propel cars
over said tracks in said street, locomotives and/or engines driven by steam,
oil, gasoline, electricity and/or by any other type of motive power.
The top of the rails of said railroad tracks shall be constructed on
a level with the surface of the streets in which they are laid. The additional
tracks shall be of standard gauge width, laid on suitable foundation and shall
be constructed and maintained in such a manner as will permit automobiles,
trucks and other vehicles to freely cross and recross the tracks. The Pennsylvania-Reading
Seashore Lines shall keep the surface of the streets between the rails of
said railroad tracks and for two feet on the outside of each rail in good
repair and condition.
Said railroad company and/or its assigns shall lay, construct and maintain
its tracks authorized herein at its own expense and shall bear the full expense
of maintaining the same without prejudice, however, to its right to seek reimbursement
for all or a portion of such construction and maintenance costs from Anchor-Hocking
Glass Corporation in accordance with a proposed sidetrack agreement with that
company.
The consent hereby granted for the use of Penn (Fifth) Street and Howell
Street shall be perpetual, and the City of Salem shall not make or levy any
rent, fee or charge for said use thereof.
All the work required to be done hereunder shall be done under and according
to the ordinances and public regulations of the City of Salem.
