Borough officials shall be qualified voters
of the Borough and shall have been residents continuously in the Borough
for at least one year preceding election, and must remain continuous
residents during their terms of office.
The Council shall have the power to fix compensation
of its members and other Borough officials. No change in compensation
should become effective during their current term of office.
The office of any elected official shall become
vacant upon death, resignation, removal from office, forfeiture of
office, or conviction of a felony or a crime related to the office.
In addition, forfeiture of office shall occur if a member of Council
or the Mayor is absent from three consecutive regular meetings of
the Council without having been excused by the Council. Council shall
establish a procedure for notification and the excusing of members
of Council and the Mayor from attending meetings.
The Council shall by appointment by a majority
vote of the total number of the Council fill any vacancy in an elected
office. Should the Council fail, for any reason whatsoever, to fill
a vacancy within 30 days after the vacancy occurs, then the Court
of Common Pleas shall, upon petition of the Council or of any five
citizens of the Borough, fill by appointment the vacancy in such office.
Any person appointed to fill a vacancy shall possess all the qualifications
required of members of the Council as set forth in this Charter.
Every elected officer, prior to assuming office,
shall take and sign an oath or affirmation to support the Constitutions
of the United States of America and of the Commonwealth of Pennsylvania,
and to perform the duties of his or her office with fidelity. The
oath or affirmation may be taken and signed before any Judge or District
Justice of the Commonwealth of Pennsylvania, or, in the case of the
Mayor, also before a Notary Public, or in the case of other public
officials, before the Mayor of the Borough. No person shall be permitted
to assume such office until the oath, in written form, has been filed
with the Borough Secretary.
